15.04.010 - Definitions and references.

A. As used in this chapter or in any code adopted by this chapter, "building official," "building director," or "administrative authority" means the building inspector.

B. As used in this chapter or in any code adopted, all references to the "board of appeals" shall be interpreted as references to the city council, except the board of appeals for the uniform abatement of dangerous buildings, which shall be established by appointment by the city council.

C. As used in this chapter the following shall apply:

  1. The California Building Code, including Appendix Chapters, may be abbreviated CBC.

  2. The California Mechanical Code, including Appendix Chapters, may be abbreviated CMC.

  3. Uniform Housing Code may be abbreviated U.H.C.

  4. Uniform Sign Code may be abbreviated U.S.C.

  5. Uniform Code for the Abatement of Dangerous Buildings may be abbreviated U.C.A.D.B.

  6. The California Electrical Code, including Appendix Chapters, may be abbreviated CEC.

  7. The California Plumbing Code, including Appendix Chapters, may be abbreviated CPC.

  8. Uniform Swimming Pool Code may be abbreviated U.S.P.C.

  9. The California Fire Code, including Appendix Chapters, may be abbreviated CFC.

  10. Code of ordinances of city of Chowchilla may be referred to as ordinance, the ordinance or this ordinance, all meaning this ordinance as adopted by the city council, and as may be codified hereafter.

15.04.020 - Owner's permit.

Except as provided by this title, permits required shall be issued only to contractors licensed by the state to engage in the business or act in the capacity of a contractor in a specified field. The building inspector may issue a permit to the owner of a building on property for installations, alterations, changes or repairs of specified work, provided the work is done by the owner; provided, however, that permits for electrical work shall be issued only as provided in Sections 15.08.200 through 15.08.310, inclusive.

15.04.040 - Building permit—Required for designated work.

No person shall erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish any building or structure, or install, repair or change any plumbing fixture or piping, or install any electrical wiring, devices, appliances or equipment, or make any alterations in such existing wiring, devices, appliances or equipment, or install any gas piping, appliances or equipment or make any alterations in such existing installation or cause the same to be done, without first obtaining a separate permit for each undertaking from the building official.

15.04.050 - Building permit—Installation of curbs, gutters and sidewalks prerequisite to issuance—Variance.

No building permit shall be issued for any building to be erected, substantially enlarged or moved to a new location within the city unless and until suitable concrete curbs, gutters and sidewalks have been installed or provided for; provided, however, that where practical difficulties or unnecessary hardships result from the strict application of the within requirement, a variance may be granted by the city council upon the application to the city council stating the reasons why a variance should be granted. The installation of curbs, gutters and sidewalks as required herein shall be done in accordance with the provisions of Chapter 12.04 of this code.

15.04.060 - Provisions for the physically disabled required where.

All public accommodations or facilities as defined in Section 19955 and 1955.5 of the Health and Safety Code of the state shall have provisions for the physically disabled installed in accordance with the American Standard Specification.

15.04.110 - Certificate of insurance or consent to self-insure.

Before any permit required by this chapter can be issued, the applicant must adhere to all provisions of Section 3800, Article 3, Chapter 4, Construction Permit of the Labor Code of the state of California.

15.04.160 - Adoption of the California Building Standards Administrative Code.

Pursuant to the provisions of Section 50022.2 of the Government Code of the State of California, the city council of the city of Chowchilla does hereby adopt by specific reference thereto and incorporation herein by said reference, the provisions, rules and regulations specified and set forth in the current version of California Code of Regulations Title 24, known as the California Building Standards Administrative Code, California Administrative Code, California Building Code, California Residential Code, California Electrical Code, California Mechanical Code, California Plumbing Code, California Energy Code, California Fire Code, California Green Building Standards Code, and California Referenced Standards Code, together with all appendices, copies of which are on file with the city of Chowchilla for public record and inspection. These are hereby adopted by said city council by reference as the California Building Standards Administrative Code of the city of Chowchilla and made a part of this chapter as though set forth in full, subject, however, to the amendments, additions, deletions and fee exceptions as set forth in this chapter.

15.04.170 - Amendments, additions, deletions and fee exceptions.

DELETE: Sections 4-231 through 4-234; 4-320 through 4-326; 5-104 through 5-108; 7-133 and 7-134; and 16-401 and 16-402 (relating to fees).

ADD: PERMIT FEES: The provisions for permit fees and all matters relating to permits and fees shall be as set forth in the latest resolution adopted by the city council establishing a schedule of fees and charges.

15.04.180 - Violation—Penalty added.

A. It shall be unlawful for any person, firm, or corporation, to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish, equip, use, occupy, or maintain any building or structure in the city, or use or permit the same to be done, contrary to or in violation of any of the provisions of this title. The building official or his/her authorized representative shall issue a citation for an infraction, unless a determination has been made by the city attorney that a misdemeanor charge is not appropriate.

B. Except as otherwise provided, a violation of any provision of this chapter is deemed a violation under the provisions of the city of Chowchilla Administration Citation Ordinance (Title 1, Chapter 1).

C. Nothing in this chapter precludes the city of Chowchilla from using any other available methods to enforce provisions of this chapter including, but not limited to, initiation by the city attorney of any civil or criminal actions.
