10.48.010 - Application of provisions.

The provisions of this part shall apply only to bicycles propelled wholly or in part by muscular power having wheels with a diameter of twenty inches or more.

10.48.020 - Effect of regulations.

(a) It is an infraction for any person to do any act forbidden or fail to perform any act required in this chapter.

Violations shall be punishable by the following penalties:

(1) A fine not exceeding one hundred dollars for the first violation;

(2) A fine not exceeding two hundred dollars for a second violation within one year;

(3) A fine not exceeding five hundred dollars for a third violation within one year.

(b) Notwithstanding any provision to the contrary, a fourth or subsequent violation in any one year period shall constitute a misdemeanor, and upon conviction be punishable by a fine of not more than one thousand dollars and/or imprisonment of not more than six months.

(c) The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions contained in this chapter.

10.48.100 - Traffic laws apply to persons riding bicycles.

(a) Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this state declaring rules of the road applicable to vehicles or by the traffic ordinances of this city applicable to the driver of a vehicle, except as to special regulations in this title and except as to those provisions of laws and ordinances which by their nature can have no application.

(b) No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped.

10.48.110 - Riding on roadways and bicycle paths.

(a) Every person operating a bicycle upon a roadway shall ride as near to the right-hand side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction.

(b) Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles.

(c) Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway.

10.48.120 - Riding on sidewalks.

No person shall ride a bicycle upon any sidewalk.

10.48.130 - Clinging to vehicles.

No person riding upon any bicycle shall attach the same or himself to any streetcar or vehicle upon a roadway.

10.48.140 - Carrying articles.

No person operating a bicycle shall carry any package, bundle, or article which prevents the rider from keeping at least one hand on the handle bars.

10.48.150 - Parking of bicycles.

No person shall park a bicycle upon a street other than upon the roadway against the curb except that the parking of bicycles on sidewalks is permitted if such bicycle is equipped with a kick-stand and the same is utilized, and such parking shall be as close to the curbing as possible.

10.48.160 - Lamps and other equipment on bicycles.

(a) Every bicycle when in use at night-time shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least five hundred feet to the front and with a red reflector on the rear of a type which shall be visible from all distances from fifty feet to three hundred feet to the rear when directly in front of lawful upper beams of headlamps on a motor vehicle. A lamp emitting a red light visible from a distance of five hundred feet to the rear may be used in addition to the red reflector.

(b) Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement.

(c) All bicycles used or proposed to be used in commercial activities including, but not limited, to the use in making delivery of newspapers, periodicals and other deliveries shall be subject to inspection by the police department every three months and shall be equipped with such safety devices as may be recommended by the police department.

10.48.170 - Penalties.

The chief of police of the city as well as any member of the police department thereof may impound and retain possession of any bicycle operated, parked or used in violation of any of the provisions of this chapter, and may retain possession of any such bicycle until the license provided for herein is obtained by the owner of the bicycle, criminal proceedings for the violation resulting in the impounding have been terminated and the judgment satisfied, and all charges and expenses incurred by reason of the impounding, including but not limited to storage charges, have been paid by the owner of the bicycle. The police department and members thereof are authorized to store any bicycles impounded in garages or other suitable places and to incur storage charges therefor. Such storage charges shall be paid by the owner of the bicycle.
