9.08.010 - Consumption of alcohol in public places unlawful.

It is unlawful, except as provided below, for any person to drink or consume, or to attempt to drink or consume, any alcoholic beverage while such person is in or upon any public park, street, alley, highway, or in any place open to the public, except on church grounds and in an on-sale licensed establishment as licensed by the Department of Alcoholic Beverage Control.

The city manager is authorized to grant exemptions to this rule for specific festivities based on the following criteria.

A. The festivity is celebrating a national, state or similar holiday;

B. Sufficient police or private security will be provided to insure the safety of the public;

C. A service club, chamber of commerce or similar organization has agreed to be responsible for the organization and supervision of the event;

D. The festivity will begin and end on a specific date and time.

9.08.020 - Violation.

Violation of this chapter shall constitute an infraction. Every violation determined to be an infraction is punishable by a fine not exceeding one hundred dollars.
