8.34.010 - Prohibited areas designated.

It is unlawful for any person to urinate and/or defecate, or attempt to urinate and/or defecate upon any public park, street, alley, highway or other public place or in any place open to the public except designated public or private restroom facilities.

8.34.020 - Violation—Penalty.

Violation of this chapter shall be prosecuted as an infraction or a misdemeanor at the discretion of the city attorney. Every violation of this chapter is punishable by:

A. A fine not to exceed fifty dollars for a first violation;

B. A fine not to exceed one hundred dollars for a second violation within one year;

C. A fine not to exceed two hundred fifty dollars for each additional violation within one year;

D. In the discretion of the court, community service may be ordered in lieu of all, or part, of the fine imposed.
