8.16.010 - Defined.

For the purpose of this chapter, any person, firm, or corporation which sells or offers for sale food prepared for immediate consumption, whether the same is sold in a building or from a wagon or cart on the street or elsewhere, which food is offered to the public, shall be considered as conducting a public eating place.

8.16.020 - License—Required.

Any person, firm, or corporation conducting a public eating place must obtain a license from the inspector of food products.

8.16.030 - License—Term—Fee.

The license required by Section 8.16.020 shall be issued for the current calendar quarter of a year or fraction thereof, and a charge of three dollars shall be made for the same.

8.16.040 - License—Display of receipt or plate.

License receipts must be on public display in all public eating places by the side of the monthly inspection cards, or in the case of wagons or carts, a plate must be affixed thereto in a prominent place, which plate shall bear the license serial number, and which will be furnished by the inspector of food products at cost.

8.16.050 - Permitting inspection—Revocation of license.

Any public eating place licensee must during all operating hours keep said place open to the inspectors of food products; and should said place of business fall below the standard of the third class as set forth in Section 8.16.080, then the license shall be revoked until such time as he may have complied with the requirements of the inspector of food products.

8.16.060 - Employing diseased or exposed persons prohibited.

No public eating place licensee shall, upon the penalty of revocation of his license, employ any person suffering from a communicable disease, or at whose place of abode there exists a case of a communicable disease.

8.16.070 - Inspection—Regulations.

A. Monthly Inspection. All public eating places, including the dining rooms, kitchens, supply rooms, wagons, carts, etc., shall be inspected at least once each calendar month by an inspector of food products.

B. Time. No regular date or time shall be set for such inspection nor shall the inspector notify in advance the proprietor of any place to be inspected.

C. Scope. Such inspection shall be thorough and take into consideration all features from cleanliness of service, dishes, utensils, etc., to cleanliness of kitchens, employees, etc., also glass and grades of food sold.

8.16.080 - Inspection—Classifications.

A. Designated. As a result of such inspections as required by Section 8.16.070, all public eating places shall be classed in three classes as follows:

  1. Class One. Class one shall be an eating place which is as nearly perfect as possible, and in which no improvement can be suggested.

  2. Class Two. Class two shall embrace those eating places which are not perfect, but mediocre in one or more features, though still supplying a fairly safe food product.

  3. Class Three. Class three shall cover all eating places where operation would be barely permissible under the law.

B. License Revocation for Lower Grade. All public eating places of a grade lower than three shall have their license revoked until all changes ordered by the inspector of food products have been made.

8.16.090 - Inspection—Cards.

A. Display. As a result of such inspection as required by Section 8.16.070, a card shall be securely placed in a conspicuous place near the entrance of such public eating place, or in a prominent place on such wagon or cart.

B. Form. Such cards shall have the following wording:

"Public Eating Place of the _______ Class. Calexico Inspector of Food Products Inspection Card Month of _______, 19___.

Name _____ _____ Inspector."

C. Color. Such cards shall be printed on blue stock for the first class, on red stock for the second class, and on yellow stock for the third class.
