5.72.010 - Business areas—Generally.¶
A. Designated. After the effective date of the ordinance codified in this section, no license or permit shall be granted for the operation, conduct or maintenance of any poolroom or billiard parlor in the city, whether operated, conducted or maintained by themselves or in conjunction or connection with any other business or businesses, unless such poolroom or billiard parlor is located in the area or district and upon those streets described as follows:
On First Street between Rockwood and Heffernan Avenues;
On Paulin and Rockwood Avenues, between First and Second Streets;
On Heffernan Avenue between the International Boundary Line and Second Street; and
On the south side of Second Street between Imperial and Paulin Avenues.
B. Distribution of Establishments. The number of such places of business shall be limited to not to exceed one to each block of the streets designated in subsection A of this section.
C. Operation in Other Areas Prohibited. It is unlawful to maintain, conduct or operate any such poolroom or billiard parlor business within or upon any areas, districts or streets of the city other than those specifically authorized in subsection A of this section.

5.72.020 - Business areas—Existing establishments on Second Street.¶
A. Conditions for Continuance. Any such places of business as described in Section 5.72.010 being maintained, conducted or operated upon Second Street in the city on July 21, 1942, may continue to be maintained, conducted and operated upon said Second Street so long as the licenses issued and outstanding therefor on July 21, 1942, are in good standing and continued use by the same owner or owners thereof.
B. Restricted to Same Block. Such places of business shall be permitted to be located only in the same block upon said Second Street in which they were being maintained, conducted and operated on July 21, 1942.
C. Prohibited on North Side of Street. None of such businesses shall be permitted to be located upon the north side of said Second Street.

5.72.030 - License—Application—Filing.¶
Any person, firm, copartnership, association, club, or corporation desiring to engage in the business of maintaining, conducting or operating any poolroom or billiard parlor, whether alone or in conjunction or connection with any other business or businesses, shall file an application therefor with the city clerk.

5.72.040 - License—Application—Contents.¶
The application required by Section 5.72.030 shall contain the following statements:
A. The name and address of the applicant;
B. In the event the applicant is a copartnership or association, the names and addresses of the members thereof;
C. In the event the applicant is a corporation, the principal place of business of said corporation, and the names and addresses of the principal officers and the managing officer or agent thereof;
D. The description of the premises wherein it is proposed to conduct the business sufficient to identify the same;
E. The capacity in which applicant occupies the same; namely, whether as owner or lessee or otherwise;
F. The business last engaged in by the applicant and the place where such business was conducted;
G. If the applicant is an incorporated club, then whether such club has paid its license fee to and is in good standing with the state of California.

5.72.050 - License—Application—Verification.¶
The application required by Section 5.72.030 shall be verified by the applicant. Where the applicant is an association or corporation, then the application shall be verified by the duly authorized officers thereof.

5.72.060 - License—Application—Deposit.¶
The application required by Section 5.72.030 shall be accompanied by a deposit of money equivalent to the license fee for the first month.

5.72.070 - License—Issuance.¶
Upon fulfilling the requirements of Sections 5.72.030 through 5.72.060, the application shall be presented to the city council and, if granted, the chief of police shall sign and issue a license to the applicant named therein for the period set forth in said license, subject to the conditions, provisions and requirements of this chapter.

5.72.080 - License—Not negotiable.¶
The license issued under this chapter shall not be negotiable.

5.72.090 - License restriction upon reissuance.¶
In the event any of such licenses issued under this chapter lapses or is cancelled, suspended or revoked for any cause whatsoever, such licenses shall not be reinstated, renewed or reissued for use at any location upon Second Street as designated in Section 5.72.020.

5.72.100 - Conduct of business.¶
The business for which the license is granted shall be maintained and conducted in a lawful, peaceful and orderly manner.

5.72.110 - Minors.¶
No person under the age of eighteen years shall be permitted to engage in any game or games maintained, conducted or operated by the business designated in this chapter, nor shall such person be permitted to act as bystander of such games, nor enter upon or remain on the premises where the same are conducted.

5.72.120 - License—Revocation.¶
The license provided for in this chapter may be revoked by the city council for violation of laws or ordinances governing gambling; for loud, disorderly or lewd conduct or breach of the peace; and for failure to observe or comply with any lawful requirements respecting public health or sanitation, housing, zoning, or other requirements lawfully imposed by general law or by city ordinances, or for permitting minors to engage in the games conducted in the maintenance of the business designated in this chapter.

5.72.130 - Waiver of requirements.¶
The city council may waive the provisions of Section 5.72.110 and subsection A of Section 5.72.010 upon an application to the city council by the licensees or proposed licensee and upon an affirmative showing that the operation of a poolroom in such a proposed location, or permitting minors to enter said establishment, shall not be detrimental to the health, welfare or morals of the community. The application for waiver shall be in writing and the waiver shall not be granted except upon an affirmative vote of at least four members of the city council.
