5.54.010 - Definitions—Yard sale, rummage sale and garage sale.¶
As used in this chapter, "yard sale," "rummage sale" and "garage sale" are synonymous and mean any event which is advertised by any means whatsoever at a location where members of the public may purchase identifiable or tangible items of personal property; provided, however, it shall not mean any event which constitutes a sales activity, wholesale or retail, by any business which has a current business license issued by the city.

5.54.020 - Permit required.¶
It is unlawful for any person to organize, conduct or operate a garage sale, as enumerated in this chapter, in the city without first obtaining a permit from the director of finance. The permit shall be posted on-site at all times during the course of the sale.

5.54.030 - Application for permit—Fees.¶
To obtain such a permit, a written application must be filed with the finance department at least two working days before the proposed event. The applicant shall apply on city forms designed for this purpose. The city council may, by resolution, establish an application fee.

5.54.040 - Limit of permits—Nonassignability.¶
Not more than six permits shall be issued to the same person or for the same premises within any calendar year. No permit shall be transferable to another person.

5.54.050 - Days and hours of sale.¶
No permit shall be approved and no sale shall be conducted for more than three consecutive days. The sale shall not be conducted before seven p.m. on permitted days.

5.54.060 - Signs.¶
Signs advertising a garage sale for which a permit is required under this chapter may be placed or erected on the sale premises, but not at any other location, subject to the following conditions:
A. The permitted signs shall not exceed a total of four square feet in area.
B. No such sign shall be displayed at times other than the permitted times of the sale.

5.54.070 - Permit revocation.¶
Any permit issued under this chapter may be revoked and any subsequent application within one year may be denied if any enforcement official finds that conduct of the yard sale has created a public or private nuisance or has violated any provision of this chapter or other applicable law.

5.54.080 - Violation—Infraction.¶
Violation of any provision of this chapter constitutes an infraction.
