A. Except where building department services include a plan review, all fees established in Section 3.53.010 shall be collected at the time of application. For building department services that include plan review, fifty percent of building department fees shall be collected at the time of application and the remaining fifty percent shall be collected at the time of permit issuance.

B. All fees collected are non-refundable except for fees collected where the service is not performed. Notwithstanding the above, when an application for a building permit is withdrawn by the applicant, refunds of fees shall be made on a prorated formula based upon the amount of work expended by the building department as of the date of withdrawal of the application. The building official shall establish a formula for prorating refunds of fees established in Section 3.53.010.

C. To the extent allowable by law, the building department may refuse to provide service to a person who has accrued unpaid building department fees (e.g. reinspection fees) until such time as they are fully paid.

A. The building official shall, upon request, waive building department fees for the following projects without needing to seek the further permission of the board of supervisors:

1. County-initiated projects on county-owned property.

2. Projects to be constructed on county-owned property by nonprofit organizations who lease the property at a below-market rate pursuant to a public benefit finding made by the Calaveras County Board of Supervisors.

3. Projects to be constructed by veteran's memorial districts and fire districts as defined by state law.

B. The board of supervisors may waive building department fees for additional projects to the extent it can lawfully make a finding that waiving the fees will benefit the public at large.
