28A-1 - Mobilehome and mobilehome lot standards adopted by reference.

In order to provide minimum standards for the construction, use, maintenance and occupancy of mobile/manufactured home lots and mobile/manufactured homes and installations for supplying fuel gas, water, and electricity thereto and the disposal of sewage therefrom, subchapter 1, commencing with section 1000, of chapter 2, entitled "Mobilehome Parks Act," of title 25 of the California Code of Regulations is hereby adopted, incorporated and made a part of this chapter by reference, without further publication, as though set forth at length herein. This chapter shall apply to and govern all mobilehomes, manufactured homes, travel trailers and recreational vehicles, and accessory structures, and all such utility installations, located outside of mobilehome parks in the unincorporated areas of the county. As of the May 9, 2024, the County shall not grant a permit for the installation of a mobile/manufactured home if such mobile/manufactured home was manufactured prior to September 1, 2008.

28A-2 - Violations and penalties.

(a) Violations unlawful. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, install, connect, move, improve, remove, convert, demolish, equip, use, occupy or maintain any mobilehome, manufactured home, travel trailer, recreational vehicle, or accessory structure to any such home, trailer or vehicle, or any utility installation, or to cause or permit the same to be done, in violation of any provision of this chapter.

(b) Permits, inspections and approvals. When any person, firm or corporation is required by any provision in the Mobilehome Parks Act, which is adopted by section 28A-1, to obtain a permit, inspection or approval, it shall be unlawful for such person, firm or corporation: To fail to obtain such permit, inspection or approval; to fail to timely comply with all the requirements contained in such permit or related to such permit, inspection or approval; or to occupy or allow occupancy of the facility in question prior to final inspection thereof by the building division of the Butte County Development Services Department.

(c) Change in use. It shall be unlawful to change any use of a facility authorized by a permit issued pursuant to the Mobilehome Parks Act, which is adopted by section 28A-1, without first obtaining any required additional permit, inspection or approval.

(d) Continuing offenses. Every day any violation of this chapter occurs shall constitute a separate offense.

(e) Charging and penalties. Any violation of this chapter may be charged as an infraction or as a misdemeanor pursuant to section 1-7 of this Code and shall be subject to the penalties specified in section 1-7 or 41-5 of this Code.

(f) Violation declared public nuisance. The use or occupancy of any mobilehome, manufactured home, travel trailer, recreational vehicle, or accessory structure to any such home, trailer or vehicle, or any utility installation, in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in the manner as provided by law.
