Sec. 17.10.010. - Title.

This chapter shall be known as the "Bradbury Water Conservation/Waste of Water Ordinance" and may be cited as such.

Sec. 17.10.020. - Enforcement.

Waste of water or excessive and unauthorized use of water in the City is hereby prohibited and declared unlawful. It shall be the duty of the City Manager to enforce the provisions of this chapter.

Sec. 17.10.030. - Prohibitions.

Any one of the following acts shall constitute a waste of water, as the term is used in this chapter, and shall be prohibited at all times:

(1) The use or application of potable water to outdoor landscapes in a manner that causes runoff such that water flows onto adjacent property, non-irrigated areas, private and public walkways, roadways, parking lots or structures.

(2) The use of a hose that dispenses potable water to wash a motor vehicle, except where the hose fitted with a shut-off nozzle or device attached to it that causes it to cease dispensing water immediately when not in use.

(3) The use or application of potable water to driveways and sidewalks.

(4) The use or application of potable water in a fountain or other decorative water feature, except where the water is part of a recirculating system.

(5) The use or application of potable water to outdoor landscapes during and within the 48 hours after measurable rainfall.

(6) The irrigation with potable water of ornamental turf on public street medians.

(7) The irrigation with potable water of landscapes outside newly constructed homes and building in a manner inconsistent with regulations or other requirements established by the State Building Standards Commission and Department of Housing and Community Development.

Sec. 17.10.040. - Violations; penalty.

(a) Any act that constitutes a waste of water in violation of this chapter shall constitute a public nuisance and shall be subject to abatement in the manner and subject to citation. In any prosecution charging a waste of water or excessive and unauthorized use of water as set forth in this chapter, the waste of water or excessive and unauthorized use of water, together with proof that such waste originated at any residence or place of business, shall constitute in evidence a prima facie presumption that the owner, or occupant for the time being of such residence or place of business, was responsible for such waste.

(b) Per California Code of Regulations § 864(b), adopted by the Water Board, a violation of any of the seven prohibited actions is an infraction punishable by a fine of up to $500.00 for each day in which the violation occurs.
