§ 2.84.010. Creation and purpose of civil service system.

The purpose of the civil service system, created, is to: (1) establish an equitable and uniform procedure for attracting to the system the best and most competent persons available; (2) assure that appointments and promotions of employees in the system will be based on merit and fitness as determined by competitive tests; (3) provide a reasonable degree of security for employees in the system; and (4) ensure to the city a staff of loyal, qualified and competent employees.

§ 2.84.020. Classified service.

The classified service of the city shall consist of all positions which are included within the civil service system pursuant to this code.

§ 2.84.030. Unrepresented employees.

A. Class Established. There is created and established the classification of "unrepresented employees."

B. Designated. The city council shall, from time to time, designate by resolution full time officers and employees who shall be unrepresented employees of the city.

C. Compensation and Benefits. The city council shall, from time to time, establish the compensation to be paid to unrepresented employees, including, but not limited to appropriate retirement, health and welfare benefits.

§ 2.84.040. Adoption of personnel rules.

Personnel rules, as recommended by the chief administrative officer, subject to the provisions of this chapter, shall be submitted for approval to the city council (hereafter "rules"). Such rules shall establish specific procedures and regulations governing the phases of the civil service system. Such rules may be amended from time to time, as may be required.

§ 2.84.050. Appointment to and removal from system.

Persons shall be appointed to, and removed from, positions in the classified service in the time and manner provided in the personnel rules. Disciplinary action may be taken against persons holding such positions only pursuant to such rules.

§ 2.84.060. Contract for personnel administration services.

The city council may contract for any performance of any function relating to personnel, including, but not limited to, the performance, by the County of Los Angeles civil service commission, of the functions of the civil service commission described in the personnel rules of the city.

§ 2.84.070. Basic salary plan.

The city council shall adopt, by resolution, a basic salary plan for all officers and employees of the city. Such salary plan may, from time to time, be amended as required by the public interest.

§ 2.84.080. Holidays.

Holidays for all city officers and employees shall be those designated by resolution of the city council.

§ 2.84.090. Discrimination.

No person in employ of the city or seeking admission thereto, shall be employed, promoted, demoted or discharged, or in any way favored or discriminated against because of political opinion or affiliation, race, color, religious belief, age, handicap, sex or marital status.

§ 2.84.100. Retirement.

A contract is authorized between the city and the Board of Administration of the Public Employees' Retirement System, providing retirement benefits for employees of the city.

§ 2.84.110. Absence because of injury.

Notwithstanding any other provision of this chapter, or any other rule or regulation, the absence of any officer or employee from his or her position, caused by injury or disease for which he or she is entitled to compensation pursuant to Section 3201 et seq., of the Labor Code of the State of California, shall not constitute a break in such person's continuous service for the purpose of salary adjustments, sick leave, vacation leave or seniority rights.

§ 2.84.120. Reimbursement for damage to property.

Any officer or employee who suffers damage to his or her personal property while in the scope of his or her employment, shall be reimbursed for such damage upon certification by the chief administrative officer that such damage occurred in the course of his or her employ, and that the amount claimed is reasonable. Upon approval of such item by the chief administrative officer, a warrant in that amount, payable to the employee suffering the damage, shall be submitted to the city council for approval at its next regular council meeting.

§ 2.84.130. Political activities.

No person, other than elective officers, while holding any position in the classified or unclassified city positions shall engage in any political activity during such time as such person is on duty. Any such person, except for elective officers, who files, or permits the filing of, a nominating paper, placing his or her name in nomination for any elective office of the city, shall be deemed to have resigned, effective immediately, from his or her position with the city.
