§ 2.36.010. Established.¶
The Bell community housing commission is established.

§ 2.36.020. Membership—Meetings.¶
A. The housing commission shall consist of the following: the chief administrative officer, the director of development services, two full-time, permanent residents of the housing authority, one of which shall be over the age of 62 herein designated "tenant members" and one additional member herein designated "community representative" who shall not be required to be a resident of the city. The housing commission shall hold meetings at least quarterly at a date, time and place set by the housing commission.
B. The tenant members and the community representative of the housing commission shall be appointed by the housing authority board of directors at a regularly noticed public meeting.

§ 2.36.030. Term of members.¶
A. Each member of the housing commission shall serve for an initial term of two years. Thereafter, the housing authority board shall appoint three members to serve for two-year terms and two members to serve for four-year terms. Thereafter, all members shall serve for four-year terms.
B. Members of the housing commission serve at the pleasure of the housing authority board and may be removed, with or without cause as set forth in Section 2.32.030 of this code and, in addition, the memberships on the housing commission of the chief administrative officer and director of development services shall terminate upon termination of their employment with the city. Except as set forth in this chapter the rules and procedures for appointment and removal of members of city commissions set forth in Chapter 2.32 of this code shall be applicable to the housing commission except that the housing authority board shall replace the city council as to all functions and duties set forth therein.

§ 2.36.040. Duties.¶
The housing commission shall perform the following duties:
A. Hear and decide upon appeal disputes between tenants of the housing authority and the housing authority staff or manager. The housing commission shall only hear such disputes after they have been heard by the authority management and the tenant's respective tenant committee;
B. Hear and make recommendations to the Bell community housing authority board on budget, management and operation matters of the Bell community housing authority.

§ 2.36.050. Appeals.¶
Appeals from decisions of the housing commission to the housing authority board shall be as follows:
A. An interested party who may be dissatisfied with the findings of the housing commission may petition for an appeal to the housing authority board by filing a written request for an appeal with the city chief administrative officer within 10 days after the date of the commission's action.
B. Upon receipt of a copy of the written request for an appeal the housing commission shall transmit all records pertaining to the appeal to the chief administrative officer. The chief administrative officer shall forward all records to the housing authority board. The housing authority board may, within the next 60 days, place on their agenda this written request for an appeal hearing. The housing authority board shall have at least three affirmative votes to allow the appeal to be scheduled for hearing. In the event an appeal hearing is not scheduled before the housing authority board, the decision of the housing commission shall be deemed final.
C. Upon receipt of three positive votes the chief administrative officer shall schedule a hearing on the written request for appeal within the next 30 days. The hearing before the housing authority board shall be limited only to the facts previously brought before the housing commission and shall further be limited to a 30 minute statement by appellant before the housing authority. No new testimony shall be heard and no witness shall be presented.
D. The chief administrative officer shall give notice of the time and place of hearing on appeal by mailing a copy of the notice by first class mail, postage thereon fully prepaid, to the applicant, to the person making the appeal and to any other person who has filed a written request for notice with the housing commission.
E. The notice on appeal shall state:
The time and place of hearing;
The purpose of the hearing;
Any other information deemed necessary and desirable in the circumstances.
F. The housing authority board shall hear the matter and shall make its findings and conclusions in writing within 30 days following the close of the hearing unless good cause is shown for an extension of time and the petitioner of the appeal is notified of this extension and the reasons therefor. The city clerk shall file copies of the findings and conclusions of the housing authority board with the housing authority board and with the petitioner of the appeal. In the findings, the housing authority board shall report the facts found and in its conclusions the housing authority board shall report whether the appeal is granted, granted with conditions or denied. The decision of the housing authority board is final.
