Sec. 78-386. - Required.¶
No person shall lay or use any pipe, ditch, flume, conduit or appurtenances for transmitting and distributing water for any purpose under, along, across or upon the public streets, ways, alleys or public places within the city, unless such person has a valid and existing franchise therefor, except that this section shall not apply to the city or to the light and water department.
