Sec. 2-86. - Definitions.

The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Administrative officer means the city manager established in this division.

Sec. 2-87. - Appointment; qualifications.

The city manager shall be appointed by and serve at the pleasure of the city council and shall be chosen on the basis of his educational and experiential qualifications, which shall include a bachelor's degree in public administration or a related field. A master's degree in public administration or related field and substantial municipal administrative experience are desirable.

Sec. 2-88. - Compensation and benefits.

The city manager shall receive as compensation and in benefits those amounts and benefits that the city council shall from time to time establish and set forth by resolution or set forth by a contract entered into between the city and its city manager. The city manager's contract shall be approved by resolution of the city council. The city manager's compensation and benefits shall not be automatically amended or increased in accordance with formulas or memorandum of understanding which apply to a group of other city employees, unless such automatic amendments or increases are expressly stated in the city manager's contract with the city.

Sec. 2-89. - Councilmember's eligibility.

No member of the city council shall be eligible for appointment as city manager while serving as such member or until one year has elapsed after such councilmember shall have ceased to be a member of the city council.

Sec. 2-90. - Powers and duties.

Subject to policy prescribed by the city council, the city manager shall have the power and it shall be his duty to:

(1) Supervise the administrative affairs of the city.

(2) Make such recommendations to the city council concerning the affairs of the city as he may deem desirable, including the proposal of ordinances and resolutions he has found necessary for effective management or in the public interest.

(3) See that the city ordinances and the applicable laws of the state are enforced.

(4) Keep the city council advised of the financial condition and future needs of the city.

(5) Subject to the provisions of divisions 3, and 5 through 10 of this article, division 4 of article V of this chapter, and the public employees retirement system contract, act as department head of the general administrative department of the city government consisting only of employees, other than department heads, who are under his direct supervision and who are not under the jurisdiction of any other department head, and advise and make recommendations to the city council in the performance of its functions relating to personnel pursuant to the provisions of this chapter and the contract cited above. However, in any conflict between the provisions of this chapter and the contract cited above and the provisions of this division, the provisions of this chapter and the contract cited above shall prevail.

(6) Direct the purchasing activities for the city and all of its agencies.

(7) Investigate the operations of departments and other agencies in the city and of all contracts to which the city is a party and ensure proper performances and recommend to the city council such reorganization of offices, positions, departments or units under his direction as may be indicated in the interest of the efficient, effective and economical conduct of the city's business.

(8) Investigate all complaints in relation to matters concerning the administration of the city government and in regard to the service maintained by public utilities and see that all franchises, permits or privileges granted by the city are faithfully performed and observed.

(9) When directed by the city council, represent the city in its intergovernmental actions subject to council approval.

(10) Exercise general supervision over all public property under control of the city and supervise the administration of the final budget as adopted by the city council.

(11) Attend all meetings of the city council, unless excluded, and such meetings of boards and commissions as he chooses or which he is directed to attend by the city council and participate in discussion at such meetings but have no vote.

(12) Perform such other duties as may be prescribed by ordinance or resolution of the city council.

(13) Establish such general administrative rules and regulations as he may deem necessary or expedient in the general conduct of the departments under his jurisdiction.

(14) Devote full time to the duties of his office.

(15) Appoint, recruit, demote or remove all department heads of the city except as otherwise provided in this section.

a. Persons appointed or promoted to department head positions shall serve at the will and pleasure of the city manager and may be terminated from city employment by the city manager without proof of cause or other justification and without right of appeal or hearing.

b. Any person promoted to a new department head classification created by resolution on or after the effective date of this section shall also serve at the will and pleasure of the city manager and may be terminated from city employment by the city manager without proof of cause or other justification and without right of appeal or hearing.

c. The city manager is empowered to negotiate and enter into contracts on behalf of the city with department heads establishing terms and conditions of employment. Said employment contracts shall take precedence over and supersede any otherwise applicable ordinance, resolution, rule or regulation, previous or current including, but not limited to, this subsection (15) of section 2-90.

d. Nothing in this subsection shall be deemed to give the city manager the right to appoint or remove the city clerk, the city treasurer or the city attorney.

Sec. 2-91. - Jurisdiction.

(a) Subject to the laws of the state, the provisions of this Code and the policy prescribed by the council, the city manager shall have jurisdiction over all departments and agencies of the city, except the city clerk, the city attorney and the city treasurer, provided that where any such officer performs functions other than those assigned to the office by law, such additional functions shall be under the administrative direction of the city manager.

(b) The heads of the departments under the city manager shall be directly responsible to him for the efficient administration of their respective departments, and the city manager may designate acting department heads when necessary to ensure the continuity of the city's business.

(c) The city council members shall deal with the administrative services of the city only through the city manager, except for the purpose of inquiry, and no member of the city council shall give an order to any subordinate of the city manager.

Sec. 2-92. - Interpretation.

Nothing in this division shall be interpreted as prohibiting a department head from associating with, seeking advice from or giving information to any member of the city council.

Sec. 2-93. - Manager pro tempore.

The city manager, with the approval of the city council, shall from time to time designate one of the other nonelective officers of the city to serve as city manager pro tempore during any absence or disability of the city manager. If the city manager fails to make such designation, the city council may appoint an officer or department head to serve as such city manager pro tempore.

Sec. 2-94. - Bond required.

The city manager shall secure a corporate surety bond to be approved by the city council, in such a sum as may be determined by the city council, which shall be conditioned on the faithful performance of the duties imposed on the city manager as prescribed in this division. The bond fee shall be paid by the city.

Sec. 2-95. - Filing fees payable by candidates for elective offices.

Each candidate for any of the elective offices of the city shall pay upon the filing of his nomination papers a filing fee in an amount set from time to time by the city council, to defray the costs of processing a candidate's nomination papers.
