10.70.010 - Definitions.

"City" shall mean the City of Anderson.

"Food" shall be as defined in Health and Safety Code Section 113781.

"Food truck" means any mobile food facility as defined in Health and Safety Code Section 11381 and any vehicle as defined in Section 670 of the California Vehicle Code, which is equipped and used for retail sales or prepared, prepackaged, or unprepared food or foodstuffs or any kind that parks at one or more locations in the city. A food truck shall also include any trailer or wagon equipped and used as described in this section and pulled by a vehicle.

"Food truck vendor" or "vendor" means an individual or business responsible for or utilizing a food truck to sell, offer for sale, or distribute food.

"Hand washing facility" means a facility providing either a basin, container, or outlet with an adequate supply of potable water, soap, and single use towels.

"Health officer" shall be as defined in Health and Safety Code Section 111015.

"Private food truck event" shall mean an event where a food truck is vending on private property.

"Vend" or "vending" means to offer for sale or distribution.

10.70.020 - Food truck operational requirements.

A. A vendor may not operate a food truck in the City of Anderson unless one of the following applies:

  1. The food truck vendor has obtained a special event permit under Chapter 10.60 if vending on the public right-of-way or property owned by the city.

  2. The food truck vendor has obtained a private food truck event permit as set forth in permit Section 10.70.030 if vending on private property.

B. Any vendor operating a food truck in the city must obtain a business license as required under Title 5 of this code.

C. Any vendors operating a food truck in the city shall obtain a health permit from the Shasta County health officer. The health permit shall be displayed conspicuously at all times on the vendor's vehicle. Evidence of health permit shall be made available to city officials.

D. No food truck vendor shall operate more than three hundred feet travel distance of an approved and readily available toilet and hand washing facility to ensure that restroom facilities are available to vendors and their employees whenever operating.

10.70.030 - Private food truck event permit.

A. A food truck vendor may not vend or otherwise operate on private property unless the food truck vendor has obtained a private food truck event permit from the city.

B. A food truck vendor with a private food truck event permit may not operate more than three times per year at each location and cannot vend for more than three days in duration, at no more than eight hours per day. The food truck vendor will also have an hour before operating and an hour after operating which will not be counted towards the eight-hour total.

C. No food truck vendor will be permitted to vend at more than six private food truck events per calendar year.

10.70.040 - Violations.

Fines and penalties of this chapter shall be subject to the penalty and enforcement provisions of this municipal code, including, but not limited to, Chapter 1.22.

10.70.050 - Severability.

If any section, subsection, sentence, clause, phrase or word of this chapter is found to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such decision shall not affect the remaining provisions of this chapter.
