3-3.1 - Capital Outlays Fund Established.

Pursuant to the provisions of the act of the Legislature of the State of California entitled An Act to Provide for the Levy and Collection of Taxes and Assessments for the Purpose of Creating a Fund for Capital Outlays by Cities, Counties, Cities and Counties or Districts, as amended (Stats. 1937, Ch. 717, p. 1995, as amended by Stats. 1941, Ch. 341, p. 1590), there is hereby created and established in the City of Alameda a fund, to be known as the Capital Outlays Fund, for capital outlays.

3-3.2 - Levy and Collection of Assessments Limitation.

The City Council may by ordinance levy and collect assessments or taxes for capital outlays and may include in the annual tax levy a levy for such purposes and apportion and appropriate to the fund the moneys derived from such levy for capital outlays. The moneys so apportioned and collected from such assessments or taxes so levied shall be placed in the Fund. In making a levy for such purpose the limitations on the levying of taxes imposed by the Charter of the City of Alameda shall apply.

3-3.3 - Disbursements.

Such Fund and the moneys therein shall remain inviolate for the making of any capital outlays and no moneys shall be disbursed therefrom excepting for such a purpose; provided, however, that the City Council may submit a proposition to the electors of the City to obtain the consent of such electors to the use of the moneys in the fund, or any portion thereof, for some other specific purpose. Such proposition may be submitted at any election. It shall require a two-thirds (2/3) vote of all of the voters voting at such election to authorize the expenditure of the moneys in the Fund, or any portion thereof, for such other purpose as aforesaid.

3-3.4 - Transfer of Funds.

The City Council may transfer to such Fund any unencumbered surplus funds remaining on hand in the City at the end of any fiscal year.

3-3.5 - Capital Outlays Defined.

The term capital outlays shall mean and not be construed to include the construction, acquisition, extensions of, or additions to, utilities, other than utilities for the furnishing of a water supply.
