1.04.010 - Short title.

This code may be cited as the "Alameda County Administrative Code."

1.04.020 - Purpose.

The purpose of this code is to provide a code of rules not inconsistent with general laws of the state of California or the Charter of the County of Alameda, prescribing in detail the duties and systems of office

and institutional management, accounts and reports for each of the offices, institutions and departments of the county.

1.04.030 - Definitions.

The following words have in this code the signification attached to them in this section unless otherwise apparent in the context. All other words shall have their common and ordinary meaning which shall include the meanings determined by the laws of the state and the decisions of the courts of the state.

"Appointing officer" or "appointing authority" means the officer, board, commission or body having power of appointment to any position in the service of the county.

"Board" when used alone means the board of supervisors of the County.

"Charter" means the Charter of the county of Alameda, state of California, as now or hereafter amended.

"Classified service" and "unclassified service" shall each have the meanings as defined in the Charter.

"Code" means the Alameda County Administrative Code, unless some other code is indicated.

"County" means the county of Alameda.

"County service" or "service of the county" includes the classified and unclassified service as defined in the Charter.

"Deputy" means any person in the county service who acts for the department head under the direction of and subordinate to the department head or his assistant, when appointed pursuant to Section 2.02.050 of this code.

"Employees" or "county employees" means all officers, assistants, deputies, clerks, attaches and other employees in the service of the county, except officers and county officers as defined in this section.

"Executive officer" or "department head" or "head of department" means the officer or employee who has immediate charge of a department as specified in this code.

"M-designated" or "M" means all positions in item numbers with the suffix SE, EM, SM, PA, CA, MA, or M as shown in the annual Alameda County Salary Ordinance.

"Officers" or "county officers" means all county officers as specified in the state codes of California, and all officers specified in the Charter of the county of Alameda, whether such officers or county officers are elected or appointed.

"Officers and employees" means all elective and appointive officers and employees of the county of Alameda.

"State" means the state of California.

"Supervisor" or "supervisors" means a member or members of the board of supervisors of the county of Alameda.

1.04.040 - Construction of provisions.

The provisions of this code insofar as they are substantially the same as existing provisions of ordinances or codes of the county relating to the same subject matter shall be construed as restatements and continuations and not as new enactments.

1.04.050 - State laws.

The provisions of this code insofar as they are substantially the same as existing state laws or the county Charter as they refer to subjects covered by state laws shall be construed as descriptive of such laws and shall not be construed to limit, modify or expand state laws, except where such laws empower the board to prescribe rules by ordinance or resolution.

1.04.060 - Offices and employments continued.

All persons who, at the time this code goes into effect, hold an office or employment under any ordinance, or code repealed by this code, which office or employment is continued by this code, continue to hold such office or employment according to their former tenure.

1.04.070 - Effect of headings.

Chapter, article and section headings contained in this code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of any section of this code.

1.04.080 - Noncompliance with administrative code—Sanctions.

Failure of a county officer or employee to comply with the provisions of this code may constitute grounds for disciplinary proceedings under civil service. Such failure on the part of an elective official may constitute malfeasance or nonfeasance in office.

1.04.090 - References include future amendments.

Whenever reference is made to any portion of this code or of any law of the state, the reference applies to all amendments and additions now or hereafter made.

1.04.100 - Savings clause.

No action or proceeding commenced before this code takes effect, and no right accrued, is affected by the provisions of this code, but all procedures thereafter taken therein shall conform to the provisions of this code so far as possible.

1.04.110 - Provisions severable.

If any provision of this code, or the application thereof to any person or circumstances, is held invalid, the remainder of the code, or the application of such provisions to other persons or circumstances, shall not be affected thereby.
