1.04.010 - Citation.¶
This code shall be known and cited as the Alameda County Ordinance Code.

1.04.020 - Tenure of present office-holders.¶
All persons who, at the time this code goes into effect, hold office under any of the ordinances repealed by this code, shall continue to hold the same according to the present tenure thereof.

1.04.030 - Pending action or accrued rights not affected—Procedure.¶
No action or proceeding commenced before this code takes effect, and no right accrued, is affected by the provisions of this code, but all procedure thereafter taken therein shall conform to the provisions of this code so far as possible.

1.04.040 - Rights under existing license or certificate not affected.¶
No rights given by any license or certificate under any ordinance repealed by this code are affected by the enactment of this code or by such repeal; but such rights shall hereafter be exercised according to this code.

1.04.050 - Construction—Provisions, etc., governing.¶
Unless the provisions of the context otherwise requires, these general provisions, rules of construction and definitions shall govern the construction of this code.

1.04.060 - Continuation of existing laws.¶
The provisions of this code, in so far as they are substantially the same as existing provisions relating to the same subject matter, shall be construed as restatements and continuations thereof and not as new enactments.

1.04.070 - Organization of code—Effect of headings.¶
This code is divided into titles, chapters, articles and sections. Title, chapter, article and section headings do not govern, limit, modify or in any way affect the scope, meaning or intent of the provisions of any title, chapter, article or section.

1.04.080 - Delegation of power and duties.¶
Whenever, by this code, a power is granted to a public officer or a duty is imposed upon a public officer, the power may be exercised or the duty performed by a deputy of the officer or by a person authorized pursuant to law by the officer.

1.04.090 - Required writings.¶
Whenever any notice, report, statement or record is required by this code, it shall be made in the English language.

1.04.100 - Construction of tenses.¶
The present tense includes the past and future tenses; and the future, the present.

1.04.110 - Construction of genders.¶
The masculine gender includes the feminine and neuter.

1.04.120 - Construction of singular and plural.¶
The singular number includes the plural, and the plural the singular.

1.04.130 - "Shall" and "may."¶
"Shall" is mandatory and "may" is permissive.

1.04.140 - Signature by mark.¶
"Signature" includes mark when the signer cannot write, the signer's name being written near the mark by a witness who writes his own name near the signer's name. A signature by mark can be acknowledged or can serve as a signature to a sworn statement only when two witnesses sign their own names thereto.

1.04.150 - State.¶
"State" means the state of California.

1.04.160 - County.¶
"County" means the county of Alameda.

1.04.170 - Board of supervisors.¶
"Board of supervisors" means the board of supervisors of the county of Alameda.

1.04.180 - Code references as applicable to amendments and additions.¶
Whenever reference is made to any portion of this code or of any other law of the state, the reference applies to all amendments and additions now or hereafter made.

1.04.190 - Meaning of section and subdivision.¶
"Section" means a section of this code unless some other statute is specifically mentioned. "Subdivision" means a subdivision of the section in which the term occurs unless some other section is expressly mentioned.

1.04.200 - Invalidity of provision or application—Effect.¶
If any provision of this code, or the application thereof to any person or circumstances, is held invalid, the remainder of the code, or the application of such provisions to other persons or circumstances shall not be affected thereby.

1.04.210 - Person.¶
"Person" includes a natural person, firm, partnership, co-partnership, association, organization, company or corporation.

1.04.220 - Applicability of code.¶
This code is applicable in the unincorporated territory of the county.
