Pedestrian protection, adjoining-property safeguards and temporary public-use of streets
CEBC Chapter 15 (§1504–§1506) sets minimum requirements for protecting pedestrians, neighboring properties and the public right‑of‑way during construction and demolition.

Overview
This part of the California Existing Building Code (CEBC) governs safety measures during construction, alteration, repair and demolition that protect pedestrians, neighboring properties and the public right‑of‑way. The rules set minimum forms of pedestrian protection (walkways, covered walkways, barriers, railings), requirements for protecting adjoining foundations and structures (including design, monitoring and removal of excavation retention systems), and controls for temporary use of streets, alleys and other public property for construction activities. See §1504 for pedestrian protection, §1505 for protection of adjoining property and §1506 for temporary use of streets and public property.
These CEBC provisions are aligned with the corresponding California Building Code safeguards during construction (Chapter 33, e.g., §§3306–3308), so practitioners should check both Chapter 15 of the CEBC and Chapter 33 of the CBC where construction-stage controls and fire‑safety coordination are needed.
Key practical points: pedestrian walkways must be provided and accessible (minimum widths and loadings are specified), covered walkways or barriers are required based on building height and distance to the lot line (see Table 1504.1), adjoining owners must be notified and retention systems engineered/monitored by a registered design professional, and materials stored in the public right‑of‑way must not obstruct hydrants, intersections or vital utility access.

CEBC § 1504.1.6 High relevance — show source text
[BS] 1504.1.6 Repair, maintenance and removal. Pedestrian protection required by Section 1504.1 shall be maintained in place and kept in good order for the entire length of time pedestrians are subject to being endangered. The owner or the owner’s authorized agent, on completion of the construction activity, shall immediately remove walkways, debris and other obstructions and leave such public property in as good a condition as it was before such work was commenced.
[BS] 1504.1.7 Adjacent to excavations. Every excavation on a site located 5 feet (1524 mm) or less from the street lot line shall be enclosed with a barrier not less than 6 feet (1829 mm) in height. Where located more than 5 feet (1524 mm) from the street lot line, a barrier shall be erected where required by the code official. Barriers shall be of adequate strength to resist wind pressure as specified in Chapter 16 of the California Building Code .
SECTION 1505—PROTECTION OF ADJOINING PROPERTY
[BS] 1505.1 Protection required. Adjoining public and private property shall be protected from damage during construction and demolition work. Protection must be provided for footings, foundations, party walls, chimneys, skylights and roofs. Provisions shall be made to control water runoff and erosion during construction or demolition activities. The person making or causing an excavation to be made shall provide written notice to the owners of adjoining buildings advising them that the excavation is to be made and that the adjoining buildings should be protected. Said notification shall be delivered not less than 10 days prior to the scheduled starting date of the excavation.
[BS] 1505.2 Excavation retention systems. Where a retention system is used to provide support of an excavation for protection of adjacent structures, the system shall conform to the requirements in Section 1505.2.1 through 1505.2.3.
[BS] 1505.2.1 Excavation retention system design. Excavation retention systems shall be designed by a registered design professional to provide vertical and lateral support.
[BS] 1505.2.2 Excavation retention system monitoring. The retention system design shall include requirements for monitoring of the system and adjacent structures for horizontal and vertical movement.

[BS] 1505.2.3 Retention system removal. Elements of the system shall only be removed or decommissioned where adequate replacement support is provided by backfill or by the new structure. Removal or decommissioning shall be performed in such a manner that protects the adjacent property.
SECTION 1506—TEMPORARY USE OF STREETS, ALLEYS AND PUBLIC PROPERTY
[BG] 1506.1 Storage and handling of materials. The temporary use of streets or public property for the storage or handling of materials or equipment required for construction or demolition, and the protection provided to the public shall comply with the provisions of the applicable governing authority and this chapter.

CEBC § 116.2 Medium relevance — show source text
The code official shall cause to be posted at each entrance to such structure a notice reading as follows: “This Structure Is Unsafe and Its Occupancy Has Been Prohibited by the Code Official.” It shall be unlawful for any person to enter such structure except for the purpose of securing the structure, making the required repairs, removing the hazardous condition, or of demolishing the same.
[A] 116.2 Temporary safeguards. Notwithstanding other provisions of this code, whenever, in the opinion of the code official, there is imminent danger due to an unsafe condition, the code official shall order the necessary work to be done, including the boarding up of openings, to render such structure temporarily safe whether or not the legal procedure herein described has been instituted; and shall cause such other action to be taken as the code official deems necessary to meet such emergency.
[A] 116.3 Closing streets. Where necessary for public safety, the code official shall temporarily close structures and close or order the authority having jurisdiction to close sidewalks, streets, public ways and places adjacent to unsafe structures, and prohibit the same from being utilized.
[A] 116.4 Emergency repairs. For the purposes of this section, the code official shall employ the necessary labor and materials to perform the required work as expeditiously as possible.
[A] 116.5 Costs of emergency repairs. Costs incurred in the performance of emergency work shall be paid by the jurisdiction. The legal counsel of the jurisdiction shall institute appropriate action against the owner of the premises or the owner’s authorized agent where the unsafe structure is or was located for the recovery of such costs.
[A] 116.6 Hearing. Any person ordered to take emergency measures shall comply with such order forthwith. Any affected person shall thereafter, on petition directed to the appeals board, be afforded a hearing as described in this code.
SECTION 117—DEMOLITION
[A] 117.1 General. When the code official determines any structure is so old, dilapidated or has become so out of repair and is dangerous, unsafe, insanitary and otherwise unfit for human habitation or occupancy the code official can order either of the following:
- The code official is permitted to authorize the owner or owner’s authorized agent to make the structure safe by repairs in order to make the structure safe and sanitary. Where there has been a cessation of construction repairs of any structure for a period of more than 2 years, the structure will be ordered demolished and removed.
- The code official is permitted to order the owner or owner’s authorized agent to demolish and remove any such structure.
[A] 117.2 Notices and orders. Notices and orders shall comply with Section 113.
[A] 117.3 Failure to comply. If the owner or the owner’s authorized agent of a premises fails to comply with a demolition order within the time prescribed, the code official shall cause the structure to be demolished and removed, either through an available public agency or by contract or arrangement with private persons, and the cost of such demolition and removal shall be charged against the real estate on which the structure is located and shall be a lien on such real estate.
CEBC § 35.151 Medium relevance — show source text
The provisions of these regulations shall apply to any portable buildings leased or owned by a school district, and shall also apply to temporary and emergency buildings and facilities. Temporary buildings and facilities are not of permanent construction but are exten- sively used or are essential for public use for a period of time. Examples of temporary buildings or facilities covered include, but are not limited to: reviewing stands, temporary classrooms, bleacher areas, exhibit areas, temporary banking facilities, temporary health screening services or temporary safe pedestrian passageways around a construction site.
In addition, to incorporate standards at least as restrictive as those required by the federal government for barrier-free design under (1) Title III (Public Accommodations and Commercial Facilities), Subpart D (New Construction and Alteration) (see 28 C.F.R., Part 36), and (2) Title II (Public Entities), Section 35.151 (New Construction and Alterations) (see 28 C.F.R., Part 35) both from the Americans with Disabilities Act of 1990, 2004 Americans with Disabilities Act Accessibility Guidelines, as adopted by the U.S. Department of Justice (see 36 C.F.R. Part 1191, Appendices B and D), and (3) under the Fair Housing Amendments Act of 1988. Some of these regulations may be more stringent than state law in order to meet the federal requirement.
1.9.1.1 Application. See Government Code commencing with Section 4450.
Publicly funded buildings, structures, sidewalks, curbs and related facilities shall be accessible to and usable by persons with disabilities as follows:
1.9.1.1.1 All buildings, structures, sidewalks, curbs and related facilities constructed in the state by the use of state, county or municipal funds, or the funds of any political subdivision of the state. For public housing see Section 1.9.1.3.
1.9.1.1.2 All buildings, structures and facilities that are leased, rented, contracted, sublet or hired by any municipal, county or state division of government, or by a special district. For public housing see Section 1.9.1.3.

ADMINISTRATION
1.9.1.1.3 All existing publicly funded buildings and facilities when alterations, structural repairs or additions are made to such buildings or facilities. For detailed requirements on existing buildings, see Chapter 11B, Division 2, Section 11B-202 . For public housing see Section 1.9.1.3.
1.9.1.1.4 With respect to buildings, structures, sidewalks, curbs and related facilities not requiring a building permit, building standards published in the California Building Standards Code relating to access for persons with disabilities and other regula- tions adopted pursuant to Government Code Section 4450, and in effect at the time construction is commenced, shall be applicable.
1.9.1.2 Application. See Health and Safety Code commencing with Section 19952.

15 CONSTRUCTION SAFEGUARDS

About this chapter: Chapter 15 looks to the construction process. Parameters are provided for demolition and for protecting adjacent property during demolition and construction. Issues such as how to provide egress and adequate water supply while the building is growing, the timing of standpipe and sprinkler installation, and protection of pedestrians are addressed. Note that this chapter is consistent with Chapter 33 of the California Building Code and Chapter 33 of the California Fire Code.
SECTION 1501—GENERAL
[BG] 1501.1 Scope. The provisions of this chapter shall govern safety during construction and the protection of adjacent public and private properties. Fire safety during construction shall also comply with the applicable provisions of Chapter 33 of the California Fire Code.
[BG] 1501.2 Storage and placement of construction equipment and materials. Construction equipment and materials shall be stored and placed so as not to endanger the public, the workers or adjoining property for the duration of the construction project.
[BS] 1501.3 Roof loads. Structural roof components shall be capable of supporting the roof-covering system and the material and equipment loads that will be encountered during installation of the system.
[BG] 1501.4 Maintenance of exits, existing structural elements, fire protection devices and sanitary safeguards. Required exits, existing structural elements, fire protection devices and sanitary safeguards shall be maintained at all times during alterations, repairs or additions to any building or structure.
Exceptions:
- Where such required elements or devices are being altered or repaired, adequate substitute provisions shall be made.
- Maintenance of such elements and devices is not required where the existing building is not occupied.
[BG] 1501.5 Removal of waste materials. Waste materials shall be removed in a manner that prevents injury or damage to persons, adjoining properties and public rights-of-way.
SECTION 1502—OWNER’S RESPONSIBILITY FOR FIRE PROTECTION
CEBC § 18.3 Medium relevance — show source text
- The deck shall be planks not less than 2 inches (51 mm) thick or wood structural panels with an exterior exposure durability classification not less than [23] / 32 inch (18.3 mm) thick nailed to the joists.
- Each post shall be knee braced to joists and stringers by members not less than 2 inches by 4 inches (51 mm by 102 mm); 4 feet (1219 mm) in length.
- A curb that is not less than 2 inches by 4 inches (51 mm by 102 mm) shall be set on edge along the outside edge of the deck.

SECTION 1506—TEMPORARY USE OF STREETS, ALLEYS AND PUBLIC PROPERTY
[BG] 1506.1 Storage and handling of materials. The temporary use of streets or public property for the storage or handling of materials or equipment required for construction or demolition, and the protection provided to the public shall comply with the provisions of the applicable governing authority and this chapter.
[BG] 1506.2 Obstructions. Construction materials and equipment shall not be placed or stored so as to obstruct access to fire hydrants, standpipes, fire or police alarm boxes, catch basins or manholes, nor shall such material or equipment be located within 20 feet (6096 mm) of a street intersection, or placed so as to obstruct normal observations of traffic signals or to hinder the use of public transit loading platforms.
[BG] 1506.3 Utility fixtures. Building materials, fences, sheds or any obstruction of any kind shall not be placed so as to obstruct free approach to any fire hydrant, fire department connection, utility pole, manhole, fire alarm box or catch basin, or so as to interfere with the passage of water in the gutter. Protection against damage shall be provided to such utility fixtures during the progress of the work, but sight of them shall not be obstructed.
SECTION 1507—FIRE EXTINGUISHERS
[F] 1507.1 Where required. Structures under construction, alteration or demolition shall be provided with not fewer than one approved portable fire extinguisher in accordance with Section 906 of the California Fire Code and sized for not less than ordinary hazard as follows:
- At each stairway on all floor levels where combustible materials have accumulated.
- In every storage and construction shed.
- Additional portable fire extinguishers shall be provided where special hazards exist, such as the storage and use of flammable and combustible liquids.
[F] 1507.2 Fire hazards. The provisions of this code and of the California Fire Code shall be strictly observed to safeguard against all fire hazards attendant upon construction operations.
SECTION 1508—MEANS OF EGRESS

SECTION 3308—TEMPORARY USE OF STREETS, ALLEYS AND PUBLIC PROPERTY
3308.1 Storage and handling of materials. The temporary use of streets or public property for the storage or handling of materials or of equipment required for construction or demolition, and the protection provided to the public shall comply with the provisions of the applicable governing authority and this chapter.
3308.1.1 Obstructions. Construction materials and equipment shall not be placed or stored so as to obstruct access to fire hydrants, standpipes, fire or police alarm boxes, catch basins or manholes, nor shall such material or equipment be located within 20 feet (6096 mm) of a street intersection, or placed so as to obstruct normal observations of traffic signals or to hinder the use of public transit loading platforms.
3308.2 Utility fixtures. Building materials, fences, sheds or any obstruction of any kind shall not be placed so as to obstruct free approach to any fire hydrant, fire department connection, utility pole, manhole, fire alarm box or catch basin, or so as to interfere with the passage of water in the gutter. Protection against damage shall be provided to such utility fixtures during the progress of the work, but sight of them shall not be obstructed.

SECTION 3309—FIRE EXTINGUISHERS
[F] 3309.1 Where required. Structures under construction, alteration or demolition shall be provided with not fewer than one approved portable fire extinguisher in accordance with Section 906 and sized for not less than ordinary hazard as follows:
- At each stairway on all floor levels where combustible materials have accumulated.
- In every storage and construction shed.
- Additional portable fire extinguishers shall be provided where special hazards exist, such as the storage and use of flammable and combustible liquids.
[F] 3309.2 Fire hazards. The provisions of this code and the California Fire Code shall be strictly observed to safeguard against all fire hazards attendant upon construction operations.

About this chapter: While the balance of the chapters in this code specify how a building is to be designed and constructed in order to be in compliance with the code, Chapter 33 looks to the actual construction process. Parameters are provided for demolition and for protecting adjacent property during demolition and construction. This chapter also addresses the need for a fire watch during nonworking hours for certain buildings once the construction has progressed significantly. Issues such as how to provide egress while the building is growing, the timing of standpipe and sprinkler installation, and protection of pedestrians are addressed.

SECTION 3301—GENERAL
3301.1 Scope. The provisions of this chapter shall govern safety during construction and the protection of adjacent public and private properties. Fire safety during construction shall also comply with the applicable provisions of Chapter 33 of the California Fire Code .
3301.2 Storage and placement of construction equipment and materials. Construction equipment and materials shall be stored and placed so as not to endanger the public, the workers or adjoining property for the duration of the construction project.
[BS] 3301.3 Roof loads. Structural roof components shall be capable of supporting the roof-covering system and the material and equipment loads that will be encountered during installation of the system.
3301.4 Maintenance of exits, existing structural elements, fire protection devices and sanitary safeguards. Required exits, existing structural elements, fire protection devices and sanitary safeguards shall be maintained at all times during alterations, repairs or additions to any building or structure.

Standpipe systems are in service and continuous to the highest work floor, as specified in Section 1509.
Portable fire extinguishers are available in locations required by Section 1507 and for roofing operations in accordance with the California Fire Code .
Where a fire watch is required, fire watch records complying with the California Fire Code are up-to-date.
[F] 1502.3.1 Violations. Failure to properly conduct, document and maintain documentation required by this section shall constitute an unlawful act in accordance with Section 113.1 and shall result in the issuance of a notice of violation to the site safety director in accordance with Section 113.2. Upon the third offense, the code official is authorized to issue a stop work order in accordance with Section 114, and work shall not resume until satisfactory assurances of future compliance have been presented to and approved by the code official.
SECTION 1503—SANITARY
[BG] 1503.1 Facilities required. Sanitary facilities shall be provided during construction or demolition activities in accordance with the California Plumbing Code .
SECTION 1504—PROTECTION OF PEDESTRIANS
[BS] 1504.1 Protection of pedestrians. Pedestrians shall be protected during construction and demolition activities as required by Sections 1504.1.1 through 1504.1.7 and Table 1504.1. Signs shall be provided to direct pedestrian traffic.

A walkway shall be provided for pedestrian travel in front of every construction and demolition site unless the applicable governing authority authorizes the sidewalk to be fenced or closed. A walkway shall be provided for pedestrian travel that leads from a building entrance or exit of an occupied structure to a public way. Walkways shall be of sufficient width to accommodate the pedestrian traffic, but shall be not less than 4 feet (1219 mm) in width. Walkways shall be provided with a durable walking surface and shall be accessible in accordance with Chapter 11 A of the California Building Code . Walkways shall be designed to support all imposed loads and the design live load shall be not less than 150 pounds per square foot (psf) (7.2 kN/m [2] ).
Frequently asked questions
When is a covered walkway required in front of a construction site?
A covered walkway is required where Table 1504.1 indicates it based on the height of construction and the distance from the work to the lot line — for example, when construction is over 8 ft and is less than 5 ft from the lot line or in certain intermediate distance ranges. See Table 1504.1 and §1504.1.
Do I have to notify neighbors before excavating?
Yes. §1505.1 requires written notice to owners of adjoining buildings advising them of the excavation and recommending protection; that notice must be delivered at least 10 days before the scheduled start of the excavation.
What limits apply to storing materials in the street or alley?
Temporary use of streets or public property for storage must follow the applicable governing authority and CEBC Chapter 15; materials must not block fire hydrants, alarm boxes, manholes, or be placed within 20 ft of an intersection or obstruct traffic signals or transit platforms.
