Chapter 6 — FLOODPLAIN MANAGEMENT ADMINISTRATOR

82.0601 Responsibilities.

The city Engineer is hereby appointed as the Floodplain Management Administrator to administer and implement the flood management provisions of this Code by granting or denying development permits in accordance with its provisions. The duties and responsibilities of the Floodplain Management Administrator or an appropriate designee shall include, but not be limited to, the following.

  • (a) Permit Review

  • (1) Review all development permits to determine that the permit requirements of this Code have been satisfied.

  • (2) Require that all other required state and federal permits be obtained.

  • (3) Determine if the site is reasonably safe from flooding.

  • (b) Use of Other Basic Flood Data

When base flood elevation data has not been provided, the Floodplain Management Administrator shall obtain, review, and reasonably utilize any base flood elevation and floodway data available from federal, state or other sources, in order to administer the Development Standards and provisions established by the Floodplain Safety Overlay District. (c) Whenever a watercourse is to be altered or relocated and is within a Floodplain Safety Overlay District or within an area identified as subject to flooding in any City-approved Flood Hazard Study, the Floodplain Management Administrator or designee shall perform the following actions.

(1) Notify adjacent communities and the California Department of Water Resources prior to such alteration or relocation of a watercourse, and submit evidence of such notification to the Federal Insurance Administration. The responsibility of providing such notification shall rest with the Public Works Department for development projects and the Flood Control District for their respective projects.

  • (2) Require that the flood-carrying capacity of the altered or relocated portion of said watercourse be maintained.

  • (d) Obtain and maintain for public inspection and make available the certifications required for developments within the Floodplain Overlay District.

(e) Make interpretations, where needed, as to the exact location of the boundaries of the areas of special flood hazards (for example, where there appears to be a conflict between a mapped boundary and actual field conditions). Any person contesting the location of the boundary may appeal the interpretation in accordance with the provisions of this Code.

(f) Take action to prosecute violations of the Flood Safety provisions of this Code as specified in Section 85.020315 herein.
