3.3.005. - Adoption of Animal Control Ordinance.¶
Except as hereinafter provided, Title 10 (Animals) of the Los Angeles County Code, as amended by Los Angeles County Ordinance No. 2022-0020 (adopted May 17, 2022), is hereby adopted by reference as the Animal Control Ordinance of the City of Westlake Village. A copy of Title 10 (Animals) of the Los Angeles County Code as amended by Los Angeles County Ordinance No. 2022-0020 has been deposited in the office of the City Clerk and shall at all times be maintained by the City Clerk for use and examination by the public.

3.3.010. - Violations and Penalties.¶
A. Except as provided in subsection B of this Section, a violation of any provision of the Animal Control Ordinance is an infraction which is punishable as provided in Chapter 1.2 of this Code.
B. A violation of sections 10.12.190, 10.12.200, 10.12.210, 10.20.280, 10.20.310, 10.28.060, 10.28.280.C., 10.32.040, 10.32.080, 10.37.150, 10.37.180, 10.40.010, 10.40.040, 10.40.065, 10.40.200.D., 10.80.010, 10.84.010, 10.84.020, 10.86.010, or any provision of Division 2 or Chapters 10.72 and 10.76 of the Animal Control Ordinance is a misdemeanor which is punishable as provided in Chapter 1.2 of this Code.

3.3.015. - Amendments.¶
Notwithstanding the provisions of Section 3.3.005, 10.20.038, 10.20.120, 10.28.061.B, 10.32.010, 10.40.065, and 10.90.010.I.C.4 of the Animal Control Ordinance are hereby amended as follows:
A. Section 10.20.038 (Residential Dogs and Cats—Limitations) is hereby amended to read as follows:
"10.20.038 Residential Dogs and Cats—Limitations.
A combined total of up to four dogs and cats may be kept at any residence without an animal facility license, provided the dogs' and cats' owner or custodian licenses each individual dog and cat. For purposes of this section, a service dog licensed under Section 10.20.090, is not counted toward the number of dogs kept or maintained, while such dog is serving a person who is mentally or physically disabled within the meaning of Government Code Section 12926(i) or Government Code Section 12926(j)."
B. Section 10.20.120 (Fees Payable—Delinquency Charge) is hereby amended to read as follows:
"10.20.120 Fees Payable—Delinquency Charge.
A delinquency charge as provided in Section 10.90.010 shall be assessed when, in violation of the provisions of this chapter, the license fees provided for in this chapter are not paid within ten days after the expiration date or the date the license is required to be obtained by the provisions of this title."
C. Section 10.28.061 is hereby deleted.
D. Section 10.32.010 (Dogs—Running at Large Prohibited—Exceptions) is hereby amended to read as follows:
"10.32.010 Dogs—Running at Large Prohibited—Exceptions. No person owning or having charge, care, custody, or control of any dog shall cause, permit, or allow the same to be or to run at large upon any highway, street, lane, alley, court, or other public place, or in or upon any property open or accessible to the residents of a neighborhood or the public including, but not limited to, privately owned common areas as defined in California Civil Code Section 4095 (or any successor statute), or upon any private property or premises other than those of the person owning or having charge, care, custody, or control of such dog, in the City of Westlake Village, unless such dog be restrained by a substantial chain leash not exceeding six feet in length and is in the charge, care, custody, or control of a competent person."
E. Section 10.40.065 (Animal Nuisance) is hereby amended to read as follows:
"10.40.065 Animal Nuisance.
It is unlawful for the owner or person having custody of any dog or other animal to permit, either willfully or through failure to exercise due care or control, any such dog or animal to commit any nuisance and to allow such nuisance to thereafter remain upon any public or private property not owned or possessed by the owner or person in control of such animal, or in or upon any property open or accessible to the residents of a neighborhood or the public including, but not limited to, common areas as defined in California Civil Code Section 4095 (or any successor statute), provided that the person who owns, harbors, keeps, or has charge or control of a dog (other than a sightless person who has charge or control of a guide dog) shall immediately and securely enclose all feces deposited by such dog in a bag, wrapper, or other container and dispose of the same in a sanitary manner. Any person (other than a sightless person with a guide dog) who has charge or control of a dog in a location other than on the property of such person or the property of the owner of the dog, shall have in his or her possession suitable wrapper, bag, or container (other than articles of personal clothing) for the purpose of complying with the requirements of this section. Failure of such person to carry such wrapper, bag, or container when in charge or control of a dog in a location other than on the property of such person or the property of the owner of the dog or animal shall constitute a violation of this section."
F. Section 10.90.010.I.C.4 of Chapter 10.90 (Fees for Services and Activities) of Division 3 (Miscellaneous Regulations) of Title 10 (Animals) is hereby deleted.

3.3.020. - Fees for Services and Activities.¶
The City Council shall establish the license fees required to be paid pursuant to this Chapter by resolution.
