3.10.005. - Title.

This Chapter shall be known and may be cited as the Electric Mobility Devices Ordinance.

3.10.010. - Definitions.

Except where the context otherwise requires, the definitions provided in this Section shall govern the construction of this Chapter. Whenever a reference is made to the Vehicle Code, the reference applies to the then-current version of such statute.

A. "Bicycle" shall have the same meaning as in Vehicle Code Section 231, including electric bicycles.

B. "Electric mobility device" means any of the following:

  1. "Electric Bicycle" has the same meaning as in Vehicle Code Section 312.5.

  2. "Electric Personal Assistive Mobility Device" has the same meaning as in Vehicle Code Section 313.

  3. "Electrically Motorized Board" has the same meaning as in Vehicle Code Section 313.5.

  4. "Motorized Scooter" has the same meaning as in Vehicle Code Section 407.5.

  5. "Pocket Bike" has the same meaning as in Vehicle Code Section 473.

C. "Operator" means a person who operates and/or controls an electric mobility device.

D. "Public area" means any outdoor area that is open to the members of the public for public use and is owned or operated by the City or a public agency.

E. "Unsafe Manner" means operating a device in any manner whatsoever that displays a willful or wanton disregard for the safety of other persons or property.

F. "Vehicle" has the same meaning as in Vehicle Code Section 670.

3.10.020. - Operation of Electric Mobility Devices.

A. No person shall operate or ride an electric mobility device: (i) upon any public sidewalk; (ii) in any public drainage facility, culvert, ditch, or channel; (iii) outside of any roadway or other paved public area; (iv) in or upon any public park, athletic field, athletic/sports court, or gymnasium in the city; (v) over any equestrian trail, or hiking or recreational trail.

B. No person shall ride a bicycle, e-bike, moped, motorized scooter, or any other electric mobility device, in an unsafe manner in any public area.

C. Operators shall allow the inspection of electric mobility devices upon lawful contact with police officers to determine if the rider is legally allowed to operate such electric mobility device.

3.10.030. - Operation of Electric Mobility Devices in Private Parking Lots.

A. There are certain privately owned and maintained off-street parking facilities within the City that are generally held open for use of the public for vehicular parking and shall be subject to public moving vehicle laws under Vehicle Code Sections 22350, 23103, 23109, and 38000 et seq. Each privately owned and maintained off-street parking facility desiring to be subject to those statutes shall post notice, compliant with Vehicle Code Section 21107.8(b), that it is subject to public moving vehicle laws.

B. Fees for violations of this section shall not exceed the limits for fees for infractions listed in Section 1.2.005 of this Code. Fees for parking violations shall not exceed the limits established by resolution by the City Council pursuant to Section 3.8.050 of this Code.

3.10.040.

  • Violations of the Operation of Electric Mobility Devices in Private Parking Lots.

A. The initial review and administrative review process of citations issued by the City or Sheriff's Department pursuant to Section 3.10.030 are the same as the initial review and administrative review processes described in Chapter 3.8 "Parking Citation Processing," except as otherwise stated in this Section.

B. An individual who receives a notice of violation of public moving vehicle laws under Section 3.10.030 may request a review of the notice by mail, telephone, or in person. The individual must request the review within 21 calendar days of the issuance of the notice of violation or 14 calendar days from the date the notice was mailed. This initial review shall be free of charge.

C. In the event the individual is dissatisfied with the results of the initial review, the person may request an administrative hearing of the violation no later than 21 calendar days following the mailing of the results. The request may be made by telephone, in writing, or in person.

3.10.050. - Enforcement.

A. Unless otherwise provided for in Section 3.10.040, a violation of this chapter shall be punishable as provided in Chapter 1.2 of this Code.

B. In the event the operator of the electric mobility device is a juvenile, officers will make every effort to contact the parent(s) or responsible guardian(s) of the operator and advise them of the nature of the violation. This shall occur at the time of the stop or as soon as practical.

3.10.060. - Exemptions.

A. The restrictions in this Chapter do not apply to persons with mobility disabilities utilizing a wheelchair or other power-driven mobility device in accordance with the Americans with Disabilities Act (42 U.S.C. Section 12101 et seq.) and Section 36.311 of Title 28 of the Code of Federal Regulations.

B. City and other public agency personnel may operate electric mobility devices at any place in the performance of their duties.
