3.2.005. - Adoption of Traffic Code.

A. Except as hereinafter provided, Title 15, Vehicles and Traffic, Division 1, Traffic Code of the Los Angeles County Code as amended and in effect on January 1, 2000, up to and including Ordinance 99-0089, is hereby adopted by reference as the Traffic Ordinance of the City of Westlake Village.

B. A copy of Title 15, Vehicles and Traffic, Division 1, Traffic Code of the Los Angeles County Code as amended and in effect on January 1, 2000, up to and including Ordinance 99-0089, has been deposited in the office of the City Clerk of the City of Westlake Village and shall be at all times maintained by the Clerk for use and examination by the public.

3.2.010. - Definitions.

Notwithstanding the provisions of Section 3.2.005 of this Chapter, whenever any of the following names or terms are used in the Traffic Ordinance, each such name or term shall have the following meanings:

A. "Board" means the City Council of the City of Westlake Village.

B. "Commissioner" means the City Manager or the City Manager's designee.

3.2.020. - Commercial and Oversize Vehicle Parking.

Notwithstanding the provisions of Section 3.2.005 of this Chapter, Division 1 of Title 15, Vehicles and Traffic, of the Los Angeles County Code is amended by amending Section 15.64.050 thereof to read:

15.64.050. Commercial and Oversize Vehicle Parking Restrictions. The following restrictions shall apply to commercial and oversize vehicles parked in residential and non-residential zoned districts:

A. No vehicle or combination of vehicles registered for commercial purposes pursuant to the applicable provisions of the California Vehicle Code, exceeding five tons in unladen gross weight shall:

  1. Be parked or left standing by any person or operator on any street, right-of-way, or public way or place in a non-residential district for a period of time in excess of four (4) hours unless loading or unloading of said vehicles is in progress.

  2. Be parked or left standing by any person or operator on any street, right-of-way, or public way or place in any residential-zoned district unless actively engaged in pick-up or deliveries of goods, wares and merchandise from or to any building or structure located within a residential zone or delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure within a residential zone.

B. Except as permitted pursuant to Subsection (A) of this Section, no person shall park or leave standing upon any street, right-of-way, or public way or place, any oversize vehicle at any time. For the purposes of this section, the term "oversize vehicle" shall mean any combination of vehicles of any length or any vehicle which exceeds twenty-one feet (21′) in length, eighty inches (80″) in width, or eighty-two inches (82″) in height. Passenger pick-up trucks with dual rear wheels may have a maximum width of ninety-five inches (95″).

C. This section shall not apply to any person who is actually engaged in the loading or unloading of any non-commercial oversize vehicle or is actually engaged in making emergency repairs thereon.

D. The City Manager may grant an exception to the prohibitions set forth in this Section to accommodate the temporary parking of an oversize vehicle upon a public right-of-way when such temporary parking is reasonably required for the preparation, loading or unloading of said vehicle prior to or following travel, or is necessary as temporary guest or visitor parking at a residential premise. Written authorization for said temporary parking may be issued upon the request of the involved property owner or resident.

3.2.030. - Driving on Grassy Areas Prohibited.

Notwithstanding the provisions of Section 3.2.005, the Traffic Ordinance is amended by adding Section 15.76.210 to read:

15.76.210. Driving on Grassy or Landscaped Areas Prohibited. No person shall drive or park any motorized vehicle in or upon any park property (except marked driveways and parking areas), median, greenbelt or other grassy or landscaped area not intended or designed for vehicular use. This Section shall not apply to City and Council vehicles while engaged in official business.

3.2.040. - Additional Definitions.

Notwithstanding the provisions of Section 3.2.005, Chapters 15.08 and 15.54 of Title 15, Vehicles and Traffic, Division 1, Traffic Code of the Los Angeles County Code are hereby amended by adding Sections 15.08.135, 15.08.175, 15.08.176 and 15.54.030 to read:

15.08.135. Pedestrian Walkway. "Pedestrian walkway" means an area within a shopping center, shopping district or business district which is closed to vehicular traffic and which is designed for pedestrian travel.

15.08.175. Shopping Center. "Shopping center" means a group of commercial establishments, planned, developed, owned, and managed as a unit, with parking provided on the property.

15.08.176. Shopping District. "Shopping district" means a collection of individual stores and other commercial establishments standing on separate lots or parcels along street frontage or clustered in a contiguous area, with or without offstreet parking.

15.54.030. Skateboarding Prohibited.

A. No person shall operate or use any skateboard on a street, sidewalk, pedestrian walkway, or parking area within a shopping center, shopping district, or business district.

B. Violation of this Section is hereby deemed to be an infraction and is punishable according to the provisions of Section 15.12.010 of this Code.

3.2.050. - Deletion from Traffic Code.

Notwithstanding the provisions of Section 3.2.005 of this Chapter, the Traffic Ordinance is amended by deleting Section 15.12.010, Chapter 15.16, Section 15.64.052, Section 15.64.060, Section 15.64.271 and Part 5 of Chapter 15.64.

3.2.060. - Preferential Parking.

A. The purpose of this Section is to create a preferential parking program which is necessary in order to alleviate the severe lack of on-street parking on certain residential streets and to provide reasonably available and convenient parking for the adjacent residents. The preferential parking program consists of a "preferential parking zone" which is defined as a street block or group of street blocks that are designated for preferential parking by the City Council.

B. A preferential parking zone may be established by submitting a request to the City Council Public Safety Committee. The City Council Public Safety Committee shall consider the request and whether the board of directors of the homeowners association for the street block or group of street blocks supports the establishment of a preferential parking zone. If the Committee recommends the establishment of a preferential parking zone to the City Council, then the City Council may approve that zone if the Council determines that the zone is necessary to provide reasonably available and convenient parking for adjacent residents.

3.2.070. - Violations and Penalties.

A violation of any provision of the Traffic Ordinance is an infraction which is punishable as provided in Chapter 1.2 of the Westlake Village Municipal Code.
