Chapter 15.52 — REGULATION OF OUTDOOR WATER USE PRACTICES

• a. No person shall water any lawn or do or permit any landscape irrigation with potable water except between the hours of 5:00 p.m. and 9:00 a.m. on the designated irrigation days set forth in subsection (d) of this section. No person shall water any lawn or do or permit any landscape irrigation during, and for forty-eight hours following any measurable precipitation. No person shall permit any irrigation system to cause any water runoff, seepage, low-head drainage, over-spray or other similar conditions onto adjacent property, non-irrigated areas, walks, roadways or structures. Parks, school grounds and recreational fields may be irrigated with potable water on any day, but no more than three times weekly and only between 7:00 p.m. and 8:00 a.m. Agricultural users, commercial nurseries/ landscape contractors may irrigate with potable or reclaimed water, but shall curtail all nonessential water uses and water run-off.

• b. Irrigation with reclaimed water is permitted on any day during the designated hours only.

• c. Lawn watering and landscape irrigation is permitted at any time if a drip irrigation system is used.

• d. A "designated irrigation day" shall be determined by resolution of the City Council. (Prior code § 4900; Ord. 91-287U § 1, 1991; Ord. 14-944 §§ 1, 2, 2014; Ord. 15-954 § 1, 2015)

• a. No person shall wash or permit the washing of buildings, facilities, equipment, autos, trucks, trailers, boats, airplanes and other types of mobile equipment except where a handheld hose equipped with a positive shut-off nozzle for quick rinses is used. Whenever possible, such as when washing vehicles, a bucket wash is required. No person shall leave a water hose running while washing a vehicle of any type or at any other time.

• b. Washing of vehicles is permitted at any time on the immediate premises of a commercial car wash. Automatic car washes and all other car wash facilities shall utilize a recycled water system.

• c. No person shall hose water on sidewalks, driveways, parking areas, tennis courts, patios or other paved areas except to alleviate immediate fire, sanitation or health hazards.

• a. No person shall fill or permit to be filled any swimming pool, wading pool, or spa unless

such pool or spa is a new facility being filled for the first time, or unless such pool or spa is being filled for the first time following repairs of leaks. No person shall top off pool water except once a week on a designated irrigation day between the hours of 6:00 p.m. and 6:00 a.m.

• b. No person shall use water to clean, fill, or maintain levels in ponds, decorative fountains or artificial lakes unless such water is part of a recycling system.

• a. No person shall use water from fire hydrants except authorized public safety personnel for fire fighting and public welfare activities.

• b. No flushing of water mains shall be permitted except as necessary to protect the public health.

• c. No restaurant, hotel, café, cafeteria or other public place where food is sold, served or offered for sale shall serve drinking water to any customer unless specifically requested by such a customer.

• d. No potable water shall be used for earth work, grading or road construction purposes. If adequate reclaimed water is not available, water use for construction purposes shall be reduced to a level which can be sustained entirely by available reclaimed water.

• e. All hotel operators, as such terms are defined in Section 3.32.020 of this code, shall provide guests with the option of choosing not to have towels and linens laundered daily. Hotel operators shall prominently display notice of this option in each guest room using clear and easily understood language.

• a. No owner of any plumbing facility within the City of West Hollywood shall permit water to leak from such facility.

• b. If a break or leak occurs within the water user's plumbing or private irrigation system, the leak shall be repaired within five calendar days after the water user discovers the leak or after the water user is notified of the leak.

• a. No homeowners' association shall impose or threaten to impose a fine, assessment, or other monetary penalty against any owner of a separate interest for reducing or eliminating the water of vegetation or lawns during a declared drought emergency, as described in the California Civil Code.

• b. No homeowners' association shall require the owner of a separate interest upon which water-efficient landscaping measures have been installed in response to a declared drought emergency, as described in the California Civil Code, to reverse or remove the water-

efficient landscaping measures upon the conclusion of the state of emergency. (Ord. 19-1054 § 8, 2019)

Any person, firm or corporation violating any of the provisions of this chapter shall be subject to the administrative penalty provisions of subsection (e) of Section 1.08.010 of this code. (Prior code § 4905; Ord. 91-287U § 1, 1991; Ord. 05-715 § 2, 2005)
