Chapter 10.07 — PARKING CODE

Whenever in this chapter the words or phrases hereinafter in this chapter defined are used, they shall have the meanings respectively ascribed to them in this chapter unless the context indicates to the contrary.

Words defined in Vehicle Code. Whenever any words or phrases used in this chapter are not defined, but are in the California Vehicle Code of this state, such definitions as now existing are incorporated herein and shall be deemed to apply to such words and phrases as used in this chapter as though set forth in full.

"Alley" means any highway, as defined in this chapter, unnamed, and having a width of less than twenty-five feet, and not provided with a sidewalk or sidewalks.

"Bus loading zone" means the space adjacent to the curb or edge of a roadway reserved for the exclusive use of buses during the loading or unloading of passengers.

"Commercial vehicle loading zone" means that space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers and materials marked and designated as hereinafter provided in this chapter.

"Director" means the Director of Public Works of the City of West Hollywood.

"Disabled parking space" means any parking space designated for the exclusive use of a vehicle displaying a special identification license plate or distinguishing placard subject to the provisions stated in Section 22511.5 of the California Vehicle Code. Disabled parking spaces shall be marked in accordance with Section 22511.7 of the California Vehicle Code.

"DPW" means the West Hollywood Department of Public Works.

"Highway" means every way set apart for public travel.

"Operator" means any person who is in actual physical control of a vehicle or streetcar.

"Park" means to stop or to allow to stand any vehicle, whether occupied or not, otherwise than in obedience to official traffic-control devices or by direction or a police officer.

"Parking Division" means the budget, management, staff, resources and policies administered under the authority of the Department of Public Works.

"Parking meter" means any mechanical or electronic meter that registers payment for an on-street or off-street parking space and is erected for the regulation of parking.

"Parking payment device" means any electronic parking meter or pay station that accepts and registers payment for one or more parking spaces.

"Parking violation" means the breach or intrusion of a vehicle required to comply with any general parking legislation enforced under the provisions of West Hollywood Municipal Code Chapter 10.07 and/or the California Vehicle Code that warrants the issuance of a parking citation penalty to the vehicle's registered owner.

"Parkway" means that the portion of a highway other than a roadway or a sidewalk.

"Passenger bus" means any bus over twenty feet long and carrying more than fifteen persons, or exceeding six thousand pounds in gross weight.

"Passenger loading zone" means that space adjacent to a curb reserved for the exclusive use of vehicles during loading and unloading of passengers, marked and designated as with white paint.

"Pedestrian" means any person afoot.

"Person" means and includes every person, firm and corporation.

"Roadway" means that portion of a highway between the regularly established curb lines or, when no curb exists, that portion improved, designated, and ordinarily used for vehicular travel and parking.

"Safety zone" means that portion of a roadway reserved for the exclusive use of pedestrians, marked and designated as hereinafter provided in this section.

"Section" means a section of the ordinance codified in the West Hollywood Municipal Code unless some other ordinance or statute is specifically mentioned.

"Sidewalk" means that portion of a highway between the curb lines or traversable roadway and the adjacent property lines.

"Street" means and includes the portion of any public street, road, highway, freeway, lane, alley, sidewalk, parkway or public place which now exists or which may hereafter exist within the City of West Hollywood.

"Taxicab" means any passenger vehicle for hire for the directed transportation of not more than eight passengers, excluding the driver, at rates based on the distance, duration or number of trips, or waiting time, or on any combination of such rates.

"Taxicab zone" means and includes the portion of the street area designated for the standing or stopping of taxicabs while awaiting employment.

"Vehicle" means every device by which any person or property is or may be transported or drawn upon a street or highway.

The Department of Public Works may install and maintain parking space markings to indicate parking spaces adjacent to any curb where parking is permitted. When such parking space markings are placed in the right-of-way, no vehicle shall be stopped or left standing other than within the markings of a single space.

No person shall fail or refuse to obey or comply with any sign, marking or device erected, made or placed to indicate and carry out the provisions of this chapter. (Ord. 07-753 § 5, 2007)

Whenever DPW finds that any portion of the highway or of a private street or any parking lot maintained or operated for the public, the city may post signs indicating a maximum time limit. If a vehicle has been parked in an area restricting parking to a specific time interval, such vehicle

shall not be re-parked within a distance of five hundred feet of the place initially parked within a period of four hours thereafter. Vehicles used for vending or peddling purposes shall also comply with the provisions of this section.

No person shall park, or cause to be parked, any vehicle within any parking facility or lot except between the lines indicating where vehicles shall be parked, and no person so park any vehicle so as to use or occupy more than one such marked parking space. (Ord. 07-753 § 5, 2007)

Wherever any parking area or portion of a parking area is assigned for the exclusive use of the occupants of a facility or the occupants of a portion of a facility and at, in or near such parking area or portion of a parking area there is a legible sign stating either that such parking area or portion of a parking area is exclusively assigned or that parking is prohibited, or both, a person, other than an occupant of the facility or an occupant of the portion of the facility to which such parking area or portion of a parking area is assigned, shall not park any vehicle in such parking area or portion of a parking area. A property owner or manager or designee responsible for overseeing the parking area may request that a parking violation be issued provided that a signed copy of a letter is on file with West Hollywood Parking Enforcement indicating contact information which will be confirmed in the event enforcement on private property is requested. A person shall not operate a motor vehicle in the bicycle lane except to cross at a permanent or temporary driveway, or for the purpose of parking a vehicle where parking is permitted or where the vehicle is disabled.

An operator shall not stop for any purpose other than loading or unloading between the hours of 7:00 a.m. and 6:00 p.m. on any day except Sunday, or at such other times as designated by the Director of Public Works, in any place marked as a commercial loading zone pursuant to the criteria established by administrative regulation. Such stop shall not exceed ten minutes for a passenger vehicle and shall not exceed twenty minutes for a commercial vehicle. The Director of Public Works shall place signs or curb markings to designate areas as commercial loading zones. Commercial loading zones shall be a minimum of thirty feet not to exceed forty-eight feet in length, and may be established in a parking meter location, in which event parking meters shall be enforced during posted hours when the loading zone is not in effect. An operator shall not stop or park for any purpose other than a stop not to exceed a period of time reasonably necessary for the deposit of mail in an adjacent mail box. (Ord. 07-753 § 5, 2007)

• a. No person shall park or leave standing upon any portion of a city street or highway within a residential zone, as shown on the official zoning map of the city as may be amended from time to time, any vehicle having either of the following:

  1. A manufacturer's rated load capacity greater than three-quarters (3/4) of a ton; or

  2. A length in excess of twenty-four feet.

• b. The following vehicles are hereby exempt from the provisions of this section:

  1. Any vehicle properly displaying a large vehicle permit. Large vehicle permits shall be issued to residents for their use and the use of their guests. Notwithstanding the above, large vehicle permits shall not be used under any circumstances on any of the following vehicles: tour buses, movie, television or photographic production vehicles, limousines, or mobile billboards in accordance with Chapter 19.80 of this code. No more than five one-day large vehicle permits may be issued to each residential unit within a three-month period;

  2. Any authorized emergency vehicle, any authorized highway work vehicle or any vehicle used in the construction, installation, or repair of a utility or a public utility in accordance with Sections 22512 and 35704 of the California Vehicle Code;

  3. Any vehicle engaged in loading or unloading;

  4. Any vehicle making pickups or deliveries of goods, wares and merchandise; and

  5. Any vehicle picking up or delivering materials used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure for which an encroachment permit or a building permit has been obtained.

• c. Pursuant to Section 40200 et seq. , of the California Vehicle Code, any violation of this section shall be punishable as a civil penalty in accordance with the provisions of Chapter 10.12 of the West Hollywood Municipal Code. Any vehicle parked or left standing in violation of this section may be removed in accordance with the provisions of Section 22650 et seq. of the California Vehicle Code.

• d. Large vehicle parking permits shall be issued by the Director of Public Works who shall establish policies and procedures for the issuance of such permits. Such policies shall be consistent with the provisions of Sections 10.08.010 through 10.08.120 of the West Hollywood Municipal Code, to the greatest extent possible as determined by the Director.

• e. The fee for a large vehicle parking permit shall be established by resolution of the City Council.

A person shall not park any trailer or semi-trailer upon any highway, street, alley, public way or place unless the trailer or semi-trailer is at all times while so parked attached to a vehicle capable of moving the trailer or semi-trailer in the normal manner upon the highway, street, alley, public way or public place.

An operator shall not park or stop any vehicle except a bus in any place marked by the Director as a bus loading zone as provided in this section. No bus shall stop in any such bus loading zone longer than necessary to load or unload passengers, except at a terminus. Appropriate signs or curb markings, or both shall indicate such bus loading zones. The Director shall place signs or red curb markings or both at such locations where traffic conditions are such that he/she deems it necessary to establish such bus loading zone. Unless otherwise specified by the Director, such loading zone shall not exceed eighty feet in length.

• (a) An operator shall not park or stop for any purpose other than a stop of not to exceed three minutes, or for such other amount of time as may be indicated on the posted sign, to load and unload passengers at any time in any of the following places:

  1. For a distance of thirty feet along any curb or entrance to any hotel;

  2. At any curb in front of any portion of the main entrance and outside vestibule of any theater during any time such theater is open for public performance;

  3. In any passenger loading zone so marked by DPW.

• (b) DPW may place curb paint markings at other locations at which it finds that traffic conditions are such as to make passenger loading zones feasible.

• (c) Valet Loading Zones. In any valet parking loading zone established by the Director of Public Works, a licensed valet parking service may only operate during the hours specified in its valet parking business license, if applicable, and according to any other terms and conditions indicated on the license.

An operator shall not park or stop in any alley for any other purpose other than the loading or unloading of passengers or materials, or both. Such operator shall not stop for the loading or unloading of passengers for more than three minutes for the loading or unloading of materials for more than twenty minutes at any time in any alley. • (a) Residential Zoned Districts. Whenever the DPW finds that traffic congestion, or the

disruption of the normal flow of traffic is likely to result from the operation, stopping, standing or parking of vehicles during the holding of public or private special events, assemblages, gatherings or functions, during the construction, alteration, repair, sweeping, for filming or other reasons, the Director may place or cause to be placed temporary signs prohibiting the operation, stopping, standing or parking of vehicles at least seventy-two hours prior to and during the period such condition exists on all affected streets. In the event of an emergency, the Director may act under this section without providing the seventytwo-hour notice required herein.

• (b) Commercial Zoned Districts. Whenever the DPW finds that traffic congestion, or the disruption of the normal flow of traffic is likely to result from the operation, stopping, standing or parking of vehicles during the holding of public or private special events, assemblages, gatherings or functions, during the construction, alteration, repair, sweeping, for filming or other reasons, the Director may place or cause to be placed temporary signs prohibiting the operation, stopping, standing or parking of vehicles at least twenty-four hours prior to and during the period such condition exists on all affected streets. In the event of an emergency, the Director may act under this section without providing the twenty-four hour notice required herein.

An operator shall not stop, park or otherwise leave standing any vehicle whether attended or unattended except in compliance with a traffic sign or signal or direction of a police officer, between a safety zone and the adjacent right hand curb or within the area between the zone and the curb as may be indicated by a sign or red paint on the curb, which sign or paint was erected. (Ord. 07-753 § 5, 2007)

Any vehicle observed parked or left standing longer than seventy-two consecutive hours in the same location may be cited and removed from the public right-of-way. (Ord. 07-753 § 5, 2007)

Every operator who parks a motor vehicle upon any highway shall first lock the ignition, remove the key and take such key with him, unless a licensed operator remains in such motor vehicle. (Ord. 07-753 § 5, 2007)

Whenever the Director of the Department of Public Works has placed or caused to be placed appropriate signs, an operator shall not park a vehicle upon any grade of seven and one half percent or more within any business or residential district without turning the wheels of the vehicle toward the curb while parked facing downhill and turning the wheels of the vehicle away from the curb while the vehicle is parked facing an uphill grade. Whenever the width of a highway and traffic conditions are such that the parking of vehicles at an angle to the curb instead of parallel to the curb will not impede traffic, and that there is need for the additional parking space which parking at an angle will provide, the DPW shall indicate at what angle traffic conditions vehicles should be parked by placing parallel white lines on the surface of the roadway. An operator shall not stop, stand or park any vehicle except between, at the angle indicated by, and parallel to both such adjacent white lines, with the nearest wheel not more than one foot from the curb.

An operator shall not park any vehicle on the roadway side of another vehicle that is stopped, parked or standing at the curb or edge of the public right-of-way, whether attended or unattended. Authorized emergency vehicles exempt from this section may display flashing or revolving amber warning lights when engaged in the enforcement of parking and traffic laws. (Ord. 07-753 § 5, 2007)

Whenever the parking of vehicles at all or certain hours of the day upon any portion of a highway or of a private street which is open to the public constitutes a traffic hazard or impedes the free flow of traffic, or both, the city shall erect signs stating that private street parking is prohibited at all or certain hours of the day.

• A. A person shall not park any vehicle, whether attended or unattended, in any private driveway or upon any public or private property and/or parking facility without the express or implied consent of the owner or person in lawful possession of such driveway, property or parking facility.

• B. This section does not prohibit any act, either expressly authorized or expressly prohibited by either Section 602 of the Penal Code, or Section 21113 of the Vehicle Code of the state of California, or by any other state law.

A person shall not park any vehicle, whether attended or unattended, regardless of loading or unloading in the public right-of-way in such a manner where the vehicle is parked in the direction of opposing traffic.

A person shall not park any vehicle, whether attended or unattended, upon any highway where the roadway is bordered by adjacent curbs or upon any private street which is open to the public, whether bordered by curbs or not, unless not less than eight feet of the width of the paved or

improved or main traveled portion of such highway or such private street opposite such parked vehicle is left clear and unobstructed for the free passage of other vehicles. (Ord. 07-753 § 5, 2007)

An operator may park within an intersection adjacent to the curb if the board finds, pursuant to Section 22500 of the California Vehicle Code, that the width of the highway and traffic conditions are such that such parking will not constitute a traffic hazard or impede the free flow of traffic.

At any place for a distance not to exceed one hundred feet where the DPW finds that parking would unduly hamper the free flow of traffic, result in special traffic hazard, or endanger public health or safety, the DPW shall place appropriate signs or markings prohibiting such parking. (Ord. 07-753 § 5, 2007; Ord. 10-859 § 10, 2010)

An operator shall not park within fifteen feet of a fire hydrant along any unmarked curb or in front of or adjacent to a fire hydrant indicated by signs or curb markings. This section does not prohibit any action prohibited by Section 22514 of the Vehicle Code or by any other state law. (Ord. 07-753 § 5, 2007)

Whenever any vehicle parking space is assigned for the exclusive use of the occupant of any building, whether residential, commercial or industrial, which parking space is within such building or elsewhere, and at, in or near such parking space there is a legible sign stating either that such space is exclusively assigned, or that parking is prohibited, or both, a person, other than the person to whom such parking space is assigned, shall not park any vehicle in such parking space except with the permission of the person to whom such parking space is assigned. The use of any official city taxicab stand or stands shall be limited exclusively to vehicles that display a taxicab vehicle permit issued by the city of West Hollywood pursuant to Chapter 5.08 and attended by a driver in possession of a valid driver's permit issued by the city. No person shall park, stop or stand any attended or unattended vehicle in an official city taxicab stand except as provided in this section.

• (a) Deposit of Fees Required. A person shall be required to deposit the proper fee for occupying a parking metered space at a charge set in the city's fee resolution during the hours and days of operation posted.

• (b) Parking Lot Requirements when Parking Meters or Parking Payment Devices Are Installed. A person shall not park any vehicle on any parking lot or public right-of-way maintained or operated by the city on which a parking meter or parking payment device is installed at any time without depositing the proper fee.

• (c) Fraudulent Payment Prohibited. No person shall deposit or cause to be deposited in any parking meter or parking payment device any foreign coin, token, slug, altered coin, object, substance, device, or substitute for lawful money of the United States or any other unauthorized payment device, or to otherwise fraudulently attempt to obtain time on a parking meter or parking payment device or otherwise avoid making the required payment.

• (d) Tampering. No person shall remove, open, deface, vandalize, tamper with, injure, break, disable or willfully impair the usefulness of any parking meter, parking payment device, or other parking equipment by any means.

No vehicular parking shall be permitted at specific locations during posted hours to allow for routine street cleaning and maintenance.

No vehicular parking shall be permitted on any portion of a sidewalk, nor shall no portion of a vehicle be parked in such a manner to overhang or encroach onto any portion of the sidewalk or parkway.

Whenever DPW finds that parking adjacent to any school property would unduly hamper the free flow of traffic or otherwise constitute a traffic hazard, the city shall place appropriate signs or markings prohibiting such parking.

Whenever DPW finds that traffic congestion is such that the movement or flow of traffic may be improved by the elimination of parking during certain peak travel times, signs prohibiting the stopping, standing or parking of vehicles shall be posted. It shall be illegal for any operator to park or leave standing a vehicle where signs indicating a peak hour traffic zone have been posted. Vehicles in violation shall be cited and/or towed whenever the parking of vehicles constitutes a traffic hazard or impedes the free flow of traffic, or both. Whenever the Director finds that the parking of vehicles, with a height of six feet or more, within one hundred feet of an intersection, creates a visibility limitation resulting in a potential traffic hazard, the Director shall erect signs or markings stating that the parking of vehicles with a

height of six feet or more is prohibited within one hundred feet of an intersection. (Ord. 07-753 § 5, 2007)

Unless exempted by the provisions of this part, no person shall park a motor vehicle in violation of any parking restrictions established pursuant to this part. Except as provided in paragraph (c), a violation of this section shall constitute an infraction, which shall be punishable by a fine as referenced in the city's Schedule of Fees and Services in effect at the time of the violation. The Director temporarily may waive existing or establish new parking regulations in order to accommodate or to mitigate the impacts of construction projects in the vicinity. (Ord. 08-781 § 4, 2008)
