Chapter 7 — BUILDINGS AND BUILDING REGULATIONS

Sec. 7-236. - Appeals.

In order to prevent or lessen the unnecessary hardship or practical difficulties in exceptional cases where it is difficult or impossible to comply with the strict letter of this article, the owner or his designated agent shall have the option to apply for an exemption from any provision of this article to the administrative review

board. The administrative review board shall be composed of the building and safety director, the police chief and the fire chief. Before any exemption may be granted, it shall be shown:

(a)

That there are exceptional or extraordinary circumstances not applicable generally to other properties.

(b)

That there is no alternate method of meeting the purpose and intent of this article other than described herein.

(c)

That the administrative review board shall exercise its power on these matters in such a way that the public welfare is secured.

(d)

That substantial justice is done most nearly in accord with the intent and purpose of this article.
