Section 16.34.010 Adoption

The 2025 California Referenced Standards Code, California Code of Regulations, Title

24, Part 12, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, is adopted by reference, and incorporated as if fully set forth in this chapter. Section 16. 36. 010 Adoption

A. Except as otherwise provided in this chapter, the Uniform Swimming Pool, Spa and

Hot Tub Code, 1994 Edition, prepared and published by the International Association of Plumbing and Mechanical Officials, except for Part I, are adopted by reference and incorporated herein as if fully set forth, except for the amendments and changes in this chapter. B. In the event of any conflict or ambiguity between any provision contained in the Uniform Swimming Pool, Spa and Hot Tub Code and any amendment or addition thereto contained of this chapter, the amendment or additions of this chapter shall control. Section 1. 17 of the Uniform Swimming Pool Code is added to read as follows:

Section 1. 17 Violations and Penalties. It shall be unlawful for any person, firm or

corporation to erect, construct enlarge, equip, use, occupy of maintain any building or structure which was unlawful at the time it was constructed and which would be unlawful under the Swimming Pool Code if constructed after the effective date of such codes, and shall constitute a continuing violation of such code. Any person, firm or corporation violating any of the provisions of this administrative code shall be guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any such provisions as so adopted is committed, continued or permitted, and upon conviction of any such violations, such person shall be punishable in accordance with the provision of Section 1. 16. 010 of this code. Section 1. 11 of the Uniform Swimming Pool, Spa and Hot Tub Code is amended to read:

Section 1. 11 Cost of Permit. Every application for a permit to do work regulated by this

code shall state in writing on the application provided for that purpose, the character of the work proposed to be done with such information pertinent thereto as may be required. Such applicant shall pay a fee in accordance with the fees adopted by the Vista City Council Resolution. Any person who shall commence any swimming pool, spa or hot tub work for which a permit is required by this code without having obtained a permit therefore shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by the section for such work, provided, however, that this provision shall not apply to emergency work when it shall be 16. 36 ( l) Vista 4/ 8/ 11)

demonstrated to the satisfaction of the administrative authority that such work was urgently necessary and that it was not practical to obtain a permit therefore, before the commencement of the work. In all such cases, a permit must be obtained as soon as it is practical to do so, and if there is an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. When extra inspections are necessary by reason of deficient or defective work, or otherwise through fault or error on the part of the holder of the permit or on the part of his employees, only one such extra inspection shall be made under the regular fee as herein prescribed; and for each and every further extra visit or inspection for which the holder of the permit or his employee is entirely responsible, the prescribed fee shall be paid. Refund: In the event that any person shall have obtained a permit and no portion of the work covered by such permit shall have been commenced and the permit has neither expired nor been revoked nor suspended and the permittee, upon presentation to the building official of a written request shall be entitled to a refund in an amount equal to 80 percent of the permit fee actually paid for such permit, however, the portion of the fee returned shall never be less than 10. 00. In case a permit is issued in error by the building official, all fees will be returned to the applicant upon request. Section 16. 38. 010 Adoption

A. Except as otherwise provided in this chapter, the Uniform Solar Energy Code,

1994 Edition, prepared and published by the International Conference of Building Officials, except for Part I, is adopted by reference and incorporated herein as if fully set forth, subject to the amendments and additions of this chapter. B. In the event of any conflict or ambiguity between any provision contained in the Uniform Solar Energy Code and any amendment or addition thereto contained in this chapter, the amendment or addition shall control. Part II of the Uniform Solar Energy Code is added to read as follows:

Violation and Penalties. Part II. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, equip, use, occupy, or maintain any building or structure which was unlawful at the time it was constructed and which would be unlawful under the solar energy code if constructed after the effective date of such codes, and shall constitute a continuing violation of such code. Any person, firm or corporation violating any provision of the solar energy code shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of the solar energy code is committed, continued or permitted, and upon conviction of any such violations, such person shall be punished by a fine of not more than $ 1, 000 or by imprisonment for not more than six months, or both such fine and imprisonment.
