9.28.010 - Definition.

The provisions of this chapter apply to the making of applications for and the granting and control of permits for the placing, erection, maintaining and removal of banners extending over, upon or along any highway or any portion thereof.

9.28.020 - Application for permits.

An applicant for a banner permit shall complete and file with the superintendent of streets an application in duplicate conforming with the provisions of Section 9.12.030 which shall contain, in addition thereto, the following:

(1) The location, dimensions, and purpose of the banner;

(2) A facsimile of the proposed banner, including any legend or written matter;

(3) The proposed date and time of day when said banner will be installed;

(4) The proposed date and time of day when said banner will be removed;

(5) Such other information as the superintendent of streets may require.

9.28.030 - Banners for public events.

Permits issued under this chapter shall be granted only to civic organizations or public bodies for the purpose of bringing to the attention of the public events which are of a general public interest. No permit shall be issued to further political, religious or private purposes.

9.28.040 - Duration of permit.

No permit shall be granted for a period of more than forty days.

9.28.050 - Special banner permit.

Every applicant for a banner permit from whom an issuance fee is required and who does not maintain a sufficient general deposit or undertaking with the superintendent of streets shall deposit with the superintendent of streets ten dollars for each banner permit.

9.28.060 - Public liability and property damage coverage.

An applicant shall submit proof of public liability and property damage insurance to the superintendent of streets in an amount of not less than one hundred thousand dollars for any one person killed or injured, and two hundred fifty thousand dollars total liability for any one accident, and an amount of not less than fifty thousand dollars for property damage.

9.28.070 - Installation of banners.

The superintendent of streets may require that the installation of any banner be under the supervision of an inspector appointed by the superintendent of streets, for which the permittee shall pay the superintendent of streets an amount equal to the compensation and cost of transportation of such inspector during the time he is assigned to such inspection.

9.28.080 - Deductions and refunds.

The superintendent of streets shall deduct from the deposit made or maintained by the permittee the following:

(1) The permit issuance fee if that has not otherwise been paid;

(2) The cost of the service and transportation of any inspector;

(3) The cost of any repairs made necessary because of installation of the banner.

The remainder of any such special deposit, if any, shall be refunded to the permittee.

9.28.090 - Removal of material and debris.

A permittee, upon the removal of any banner for which a permit under this chapter has been issued, shall remove from the highway all material and debris resulting from the installation, maintenance or removal of any banner, within twenty-four hours after the removal of a banner.
