9.26.010 - Permit required.

No person shall hold, conduct, participate in, or carry on any parade, march or procession on any street in the city or bat any drum, gong triangle or tambourine or blow, use or play any wind or stringed instrument upon any street in the city, unless the person has made written application for and received from the city engineer, a permit in writing authorizing the person to do so. All applications for the permit shall set forth the following:

(1) A map detailing the route along which the parade, march or procession proposes to travel;

(2) The date, time of the proposed starting and length of same;

(3) The names and addresses of the persons in control of the same or responsible therefor;

(4) The purpose of the parade, march or procession.

(5) The number of people that will be participating in the activity.

All permits which include closing or blocking of any streets or portions of streets, sidewalks or intersections shall be forwarded to the city public works department for a cost estimate for that department to provide traffic control devices for the parade, march or procession, and to the Victorville station of the San Bernardino County sheriff department for a cost estimate to provide an adequate level of public safety for the parade, march or procession.

Any request for a parade, march or procession which will involve the closure of any portion of a street designated as a major arterial or greater shall go to the traffic advisory committee for its determination as to whether the proposed parade, march or procession is of general benefit or interest to the community, and for its recommendation to the city engineer. The city engineer may refer any request for a parade, march or procession which will involve the closure of any portion of a street designated as an arterial to the traffic advisory committee for its recommendation.

9.26.020 - Permit fee.

Upon approval of an application to hold a parade, march or procession, the applicant shall pay to the city a permit issuance fee, and such other fees and charges in the amounts set forth in any engineering schedule of fees adopted under Section 9.04.080.

9.26.030 - Exemptions—Permit fee.

No permit fee shall be required for, of or from the following:

(1) Any nonprofit organization providing a service, by contract or other arrangement, to the city without remuneration or which otherwise is beneficial to the city;

(2) Parades sponsored by the San Bernardino County Fair Association (28th Agricultural District) when in conjunction with the annual fair.

(3) The annual holiday parade sponsored by the Victorville Chamber of Commerce.

9.26.040 - Cost reimbursement.

Applicants for a parade permit must sign an agreement stating their concurrence to reimburse the city for the direct costs incurred by the city on behalf of the organizers of the parade, march or procession. Applicants will be required to pay a deposit of one-half of the estimated costs, with the remainder to be billed to the responsible party following the event and the calculation and submittal of actual costs incurred.

The annual holiday parade sponsored by the Victorville Chamber of Commerce is not subject to this provision.

9.26.050 - Notification along parade route.

If any parade, march or procession that is located on a street designated as a major arterial or arterial, and that has been referred to the traffic advisory committee, will block access to homes or businesses for any length of time, the homes or businesses along the proposed parade route must be notified as to the time and place of the traffic advisory committee meeting at which the permit is to be discussed. Organizers of the parade, march or procession may have the city send out notices to the affected homes and businesses, and must reimburse the city for the costs involved for the notification. Organizers of the activity may elect to notify homeowners and businesses, but must show proof that the homes or businesses along the proposed parade route were notified as to the time and place of the traffic advisory committee meeting at which the permit is to be discussed.

9.26.060 - Appeals.

It is provided that any person aggrieved by any decision or determination of the city engineer may within ten business days of the date of the decision or determination appeal to the city council, which shall hold a hearing on the appeal upon giving at least ten days' notice to the appellant of the time and place of the hearing. The decision of the city council and the subject of the appeal at the hearing shall be final and conclusive.
