1511 - PLANNING COMMISSION AUTHORITY

The Planning Commission of the City of Tustin is hereby established, with composition, jurisdiction, duties, terms of office and other characteristics as provided by law and as specified herein.

Subject to the provisions of State Law, the Planning Commission shall be, and it hereby is declared to be regulated by the provisions of the Government Code of the State of California, statutes of the State of California, and such amendments thereto as may be adopted hereafter from time to time.

1512 - MEMBERS

The Planning Commission shall consist of five (5) members, each of whom shall be both residents and registered voters of the City during all times they hold office.

1513 - APPOINTMENT AND TERMS

Appointment. Members of the Planning Commission shall be appointed by the Mayor with the approval of the City Council. All members of the Commission shall serve until their respective successors are appointed and qualified.

Removal. All members of the Commission shall serve at the pleasure of the City Council and may be removed upon motion of the City Council adopted by at least three (3) affirmative votes. A member of the Planning Commission shall automatically be deemed removed from office upon certification of election of that member to the City Council as provided in Section 1305b of this Code.

Terms of Office. The terms of office of the three (3) current Planning Commission members who were appointed in 2017 are hereby extended to March 1, 2021. The terms of office of the two (2) current Planning Commission members who were appointed in 2016 are hereby extended to March 1, 2019. The term of each said office shall thereafter be for four (4) years commencing on the expiration date of each office as prescribed hereinabove.

Limitation on Consecutive Terms of Office. For all terms that commence after January 1, 2017, no person shall be eligible to serve more than two (2) consecutive four-year terms on the Planning Commission. A term of office that commenced prior to January 1, 2017, shall not be counted when determining the number of consecutive terms a Commissioner has served.

1514 - COMPENSATION OF MEMBERS

Members of the Planning Commission shall receive compensation as prescribed by ordinance of the City Council from time to time.

1515 - REGULAR MEETINGS OF THE PLANNING COMMISSION

A. The Planning Commission shall hold its regular meetings on the second and fourth Tuesdays of each month at 6:00 p.m. in the Council Chambers, Tustin City Hall, 300 Centennial Way, Tustin, California. An alternative time or location for one (1) or more regular meetings may be approved by Planning Commission Resolution approved at least seven (7) calendar days prior to the meeting date.

B. Nothing in this section limits the authority of the City or the Planning Commission to schedule a special meeting, an adjourned regular meeting, a continued regular meeting, or an emergency meeting in accordance with the Ralph M. Brown Act.

1516 - PLANNING AGENCY

Pursuant to the provisions of Section 65100 of the California Code, the Planning Commission of the City is established as the Planning Agency of the City. The Community Development Department shall assist the Planning Agency in the performance of all its duties as may now or hereafter be provided for by law.

1517 - DIRECTIONS TO COMMUNITY DEVELOPMENT DEPARTMENT STAFF

The Planning Commission may by motion regularly adopted make such requests and give such directions to the Community Development Department staff as are consistent with policies established by the City Council and within the budgetary limitations of the department.

1518 - AUTHORITY PERTAINING TO FORMER REDEVELOPMENT AGENCY

The Planning Commission shall serve as the decision making authority for land use entitlement actions that implement the General Plan and for which the former Tustin Community Redevelopment Agency is designated in any statute, ordinance, or specific plan as the decision making authority.
