4.12.1130 - Business stands on street.

It shall be unlawful for any person to place, erect, or maintain any business stand, or other obstruction on any portion of any street or sidewalk in the City without obtaining permission therefor from the Council.

4.12.1140 - Posting handbills.

It shall be unlawful for any person to post, paste, or tack any card, handbill, poster or other article of advertising upon any electric light, telegraph or telephone pole, or tree along any street within the City.

4.12.1150 - Distributing handbills in public places unlawful.

It shall be unlawful for any person to distribute, or cause to be distributed, to or among pedestrians along or upon any public street, alley, park, or other public place in the City, or to place in any automobile or other vehicle parked on or along a public street, alley, park, or other public place in the City, any advertising sample, handbill, dodger, circular, booklet, or other form of commercial advertising.

4.12.1160 - Throwing handbills on private premises unlawful.

(a) It shall be unlawful for any person to deposit or throw upon any street, alley, or public place, or upon any private yard, lawn, driveway, sidewalk, porch, or steps of any residence, or upon any property in the City, any advertising sample, handbill, dodger, circular, booklet, or other form of commercial advertising; provided, however, nothing contained in this section shall prohibit the distribution and delivery of any magazine to residents of the City who are subscribers to such magazine, and provided, further, nothing contained in this section shall prohibit the distribution and delivery of any newspaper or supplement thereof to the residents of the City.

(b) "Newspaper," as used in this section, shall mean and include any newspaper:

(1) Which has for its principal purpose the dissemination of local or telegraphic news and intelligence of a general character;

(2) Which is printed and published at regular intervals and formed on printed sheets. The newspaper cannot be a reproduction by stencil, mimeograph, or hectograph process or reproduced in imitation of typing;

(3) Which has a bona fide subscription list of paying subscribers within the City and is principally delivered only to paying subscribers; and

(4) Which is not distributed or circulated primarily for advertising purposes.

(c) "Supplement," as used in this section, shall mean any publication of a newspaper, as defined in this section, which is formed in the same manner as the newspaper and printed and published at regular intervals. The newspaper and supplement may be distributed separately.

4.12.1170 - Delivery hours for commercial advertising limited.

It shall be unlawful for any person to deliver, distribute, or leave in or upon any premises in the City any advertising sample, handbill, dodger, circular, booklet, or other form of commercial advertising between the hours of 5:00 p.m. of one day and 7:00 a.m. of the next day.
