§ 10.13.010. Cardroom regulations pursuant to Business and Professions Code Section 19851.¶
Pursuant to the police power of the County under Article XI Section 7 of the California Constitution and California Business and Professions Code section 19851, any and all gambling establishments operating within the unincorporated territory of the County of Stanislaus are subject to the following regulations in addition to the provisions of Chapter 10.12 of the Stanislaus County Code:
A. Hours of Operation. A gambling establishment shall not operate more hours on a daily basis than is permitted on the license required pursuant to Chapter 10.12 of the Stanislaus County Code. Before it shall be allowed to operate, each gambling establishment shall adopt a schedule of hours of operation, after the schedule has been approved by the sheriff or his or her representative. Such approved schedule of hours shall be clearly posted at the gambling establishment so as to give law enforcement and patrons adequate notice of the hours of operation. Unless otherwise restricted, a gambling establishment may be allowed to operate twenty-four hours each day.
B. Patron Security. Each gambling establishment licensee shall be responsible and liable for its patrons' safety and security in and around the gambling establishment. Before it shall be allowed to operate, each gambling establishment shall adopt a plan to provide for the safety and security of patrons, after the plan has been approved by the sheriff or his or her representative. As part of the plan gambling establishments shall install and maintain in proper working order, video monitoring equipment capable of providing surveillance of both interior and exterior areas of the licensed establishment. Gambling establishments shall maintain such surveillance video tapes for a period of at least thirty days and shall make such video tapes available to the sheriff or his or her representative upon demand. Gambling establishments may employ security officers so long as they meet all applicable state laws and regulations. Gambling establishments shall not permit any person or persons to loiter either inside or outside of the licensed premises.
C. Wagering Limits. There are no limits on the amount wagered in any permitted games. However, with respect to poker games, in any one hand of play, no player may wager or be required to wager a monetary amount in excess of the value of the chips the player had in his or her possession at the outset of the hand of play.
D. Location of Establishment. No gambling establishment may be located near any of the unsuitable areas, as specified in Business and Professions Code Section 19852(a)(3). The location of gambling establishments shall be identified in the application and license required pursuant to Chapter 10.12 of the Stanislaus County Code. A gambling establishment must be in compliance with all state and local zoning and land use laws, ordinances, and regulations.
E. Number of Tables. The total number of gaming tables allowed in a gambling establishment shall not exceed ten gaming tables. The number of gaming tables shall be set forth in the license required by 10.12 of this code and must be authorized and approved by the state of California and comply with any and all applicable state and local laws, ordinances and regulations.
F. Total Number of Gaming Tables in County. The total number of gaming tables allowed within the county shall not exceed twelve gaming tables.
G. Audits and Examination of Records. A gambling establishment available upon demand by the sheriff or his or her representative all records, books, ledgers, and any and all other documentation concerning the income and expenses associated with the gambling establishment. Said records, etc., shall be retained by the gambling establishment for a period of not less than five years.
H. Employees of a Gambling Establishment. Any person employed by or working in a gambling establishment in the unincorporated territory of Stanislaus County regardless of how compensated and any and all independent contractors involved in any way whatsoever with the operations of a gambling establishment shall complete an application for employment which the gambling establishment shall provide to the sheriff or his or her representative prior to the individual being employed or otherwise engaged in activities on the premises of a gambling establishment.
I. Work Permits. The county adopts any and all applicable laws and regulations, including, but not limited to, all requirements and restrictions set forth in Sections 19850 and 19910.5 of California Business and Professions Code concerning persons employed by or working in a gambling establishment and the Division of Gambling Control of the state of California shall have the authority to object to the issuance of any and all work permits for such persons.
J. Violation of Ordinance. In addition to any penalty which may be imposed for a violation of the ordinances codified in this chapter, the sheriff or his or her representative shall have the authority to terminate the license of a gambling establishment which the sheriff determines has violated any provision of this chapter.
