10.44.110 Purpose of provisions.

California Vehicle Code Section 21115 establishes the procedure by which the city may permit golf carts to be driven on local streets. It is the intent of the city to establish a procedure pursuant to California Vehicle Code Section 21115 to provide a safe and convenient means of golf cart access to golf courses and neighboring uses within the city for the health and safety of the public. It is further the intent of the city to designate streets or portions thereof for combined use by golf carts and regular vehicular travel, golf cart equipment standards and requirements, golf cart operator requirements and safety criteria, permit procedure, and enforcement standards. 10.44.120 Golf carts on local highways.

A. The following streets or portions thereof, the speed limits of which do not exceed 25 miles per hour, are designated for combined use by golf carts and regular vehicular travel:

B. The following crossing zones for use by golf carts are established:

  1. a. Crossing Highland Drive within 50 feet east of intersection with San Andres Drive.

b. Crossing Highland Drive at intersection with Via La Senda.

c. Las Banderas, approximately 300 feet north of San Andres Drive.

d. Crossing San Andres Drive at Highland Drive.

e. Crossing San Andres Drive at Ladera Linda.

  1. Operation of golf carts in the crossing zones is allowed during daytime only. Golf cart operation is prohibited during hours of darkness. “Darkness” is defined as anytime from one-half hour after sunset to one-half hour before sunrise. “Darkness” also includes the definition in Section 280 of California Vehicle Code as the same may be amended from time to time, or any state law replacing Section 280.

C. It is unlawful to operate golf carts on streets and local highways not designated in this section. (Ord. 374 § 1, 2008)

10.44.130 Operation of golf cart on local highways.

The operation of golf carts upon the streets designated under this article shall be in accordance with the following safety rules and regulations:

A. Golf cart operation is allowed during daytime hours only. Golf cart operation is prohibited during the hours of darkness. “Darkness” is defined as anytime from one-half hour after sunset to one-half hour before sunrise. “Darkness” also includes the definition in Section 280 of California Vehicle Code as the same may be amended from time to time, or any state law replacing Section 280.

B. It is unlawful for a person to drive or operate a golf cart upon the streets listed in SBMC 10.44.120(A) without a valid California driver’s license, or a driver’s license issued by another state.

C. Golf cart operators shall comply with the financial responsibility requirements established pursuant to Chapter 1 (commencing with Section 16000) of Division 7 of the California Vehicle Code.

D. Golf carts must yield the right-of-way to automobiles, pedestrians and bicyclists.

E. Golf cart operators shall only travel on designated streets as identified under SBMC 10.44.120(A) and only in those golf carts properly permitted by the city.

F. Golf cart operators shall observe all applicable provisions of the Vehicle Code, including but not limited to those related to operation of vehicles on sidewalks. (Ord. 374 § 1, 2008)

10.44.140 Golf cart permit process.

The following golf cart permitting process is established:

A. No golf cart shall be operated on city streets without a current city of Solana Beach issued golf cart permit decal visibly displayed on the left hand side of the rear of the cart or at the rear of the driver side panel.

B. No golf cart driver shall operate a golf cart within the city without complying with the financial responsibility requirements established pursuant to Chapter 1 (commencing with Section 16000) of Division 7 of the California Vehicle Code.

C. The golf cart permit shall be designed to be valid for a year and must be renewed annually.

D. A golf cart permit fee shall be established by city council resolution. (Ord. 374 § 1, 2008)

10.44.150 Enforcement provision.

Any person operating a golf cart in the city in violation of this article is guilty of an infraction. Nothing in this section shall limit or prohibit any other penalty or enforcement provision under state law or this code. (Ord. 374 § 1, 2008)
