1-4-1: VIOLATIONS DEEMED INFRACTIONS OR MISDEMEANORS WHEN; PENALTY:

(A) Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of the city shall be guilty of a misdemeanor, unless the violation is made an infraction by ordinance, the city attorney, or any court of competent jurisdiction.

(B) Except where a different punishment is prescribed by any ordinance of the city, any person convicted of a misdemeanor for violation of an ordinance of the city is punishable by a fine of not more than one thousand dollars ($1,000.00), or by imprisonment not to exceed six (6) months, or by both such fine and imprisonment.

(C) Except where a different punishment is prescribed by any ordinance of the city, any person convicted of an infraction for a violation of an ordinance of the city of Selma is punishable by:

  1. A fine not exceeding one hundred dollars ($100.00) for a first violation;

  2. A fine not exceeding two hundred dollars ($200.00) for a second violation of the same ordinance within one year;

  3. A fine not exceeding five hundred dollars ($500.00) for each additional violation of the same ordinance within one year.

(D) Each and every day a violation of any provision of this code is committed, exists or continues shall constitute a separate and distinct offense. (Ord. 2013-9, 11-4-2013)

1-4-2: ADMINISTRATIVE CITATIONS:

Any violation of this code will be subject to an administrative citation (chapter 20 of this title), unless expressly prohibited. (Ord. 2013-9, 11-4-2013)

1-4-3: CIVIL DEBT:

The amount of any tax, license, permit, service charge, costs to enforce or compel compliance of this code or any code incorporated by reference, charge for any municipal utility service, or any other amount due of any nature whatsoever imposed by any provision of this code shall be deemed a civil debt owing to the city. An action may be commenced by the city in any court of competent jurisdiction for the collection of the amount of any such delinquent or unpaid tax fee, charge, license or permit, together with any administrative fee or penalty authorized or required by this code. This remedy shall not prohibit the use of any other remedy provided by this code or by law and shall be cumulative. (Ord. 2013-9, 11-4-2013)

1-4-4: NUISANCE:

Notwithstanding any other provision of this code, any condition caused, maintained, or permitted to exist in violation of any of the provisions of this code or of the provisions of any code adopted by reference herein shall be deemed a public nuisance and may be summarily abated by the city pursuant to chapter 21 of this title. 1-4-5: LICENSE REVOCATION:

Any person in violation of any section of this code or any code adopted by reference herein may have any license, permit or other entitlement previously issued by the city revoked by the city at the discretion of the city manager or her or his designee. (Ord. 2013-9, 11-4-2013)

1-4-6: CUMULATIVE; NONEXCLUSIVE:

Nothing in this chapter is intended to be an exclusive penalty or remedy and does not prohibit the application of any other penalty or remedy available under federal, state or local law. Penalties and remedies described in this chapter are cumulative. (Ord. 2013-9, 11-4-2013)

1-4-7: LIABILITY OF OFFICERS:

No provision of this code designating the duties of any officer or employee shall be so construed as to make such officer or employee liable for any fine or penalty provided for a failure to perform such duty, unless the intention of the city council to impose such fine or penalty on such officer or employee is specifically and clearly expressed in the section creating the duty.
