Sec. B32-9. - Firearms and weapons.

No person shall possess, set, leave or deposit, fire or discharge, or cause to be fired or discharged, across, in, on or into the Matadero Creek Trails any weapon, spear, missile, sling shot, trap or hunting device, air or gas weapon, throwing knife or axe, or any other weapon or device capable of injuring or killing any person or animal, or of damaging any property or natural resource.

Sec. B32-10. - Staying on the designated trail.

Trail users must remain on the designated trail and are not permitted to enter the adjoining private property.

Sec. B32-11. - Negligent or reckless conduct.

No person shall engage in any activity, or negligently or recklessly operate any device, on the Matadero Creek Trails in a manner that will endanger any person, wildlife or property.

Sec. B32-12. - Disorderly conduct.

No person shall conduct himself or herself in a disorderly manner on the Matadero Creek Trails. Disorderly conduct means:

(1) Any person who willfully harasses or interferes with a County or Stanford employee in the performance of his or her duties on the Matadero Creek Trails; or

(2) Any person who by conduct, or by threatening or profane language annoys, willfully molests or unreasonably interferes with any other person's use of the Matadero Creek Trails.

Sec. B32-13. - Intoxicating beverages.

No person may possess or consume alcoholic beverages within or on the Matadero Creek Trails.

Sec. B32-14. - Motorized vehicles and devices.

No person shall drive or propel any motorized vehicle or other device on the Matadero Creek Trails, except for the purposes of maintenance and as permitted by law, including the use of motorized wheelchairs by persons who have mobility impairments.

Sec. B32-15. - Animals on trails.

(a) General. Dogs are allowed on the Matadero Creek Trails subject to the provisions of this section. No other domestic animals, including but not limited to, horses, are permitted on the Matadero Creek Trails.

(b) Requirements for dogs. Any person bringing a dog to the Matadero Creek Trails must comply with the following conditions and requirements:

(1) Dogs must be controlled by a leash not more than six feet in length. The individual who has the custody or care of the dog must ensure that the dog does not interfere with, bother, harass or harm trail users, other dogs, livestock, wildlife or trail resources.

(2) Dogs must remain on the designated trails and are not permitted to enter the adjoining private property.

(3) Dogs must be properly licensed, and proof of such license visible on the animal.

(4) The individual who has the custody or care of the dog must remove the animal's waste and place in a proper receptacle.

(5) Peace officers may require the individual who has custody or care of a dog to remove the dog from the Matadero Creek Trails if the individual is not in compliance with any of the provisions of this section, or if the dog poses a threat to public safety and welfare or creates a public nuisance.

(c) Revision of rules regarding dogs. In order to ensure safe use of the Matadero Creek Trails, the County Executive may establish additional requirements for dogs, such as restricting the hours or days when dogs will be allowed on the Matadero Creek Trails, or prohibiting dogs on one or both of the Matadero Creek Trails, if the County Executive determines that (i) there is an imminent threat of property damage or personal injury as a result of the continued presence of dogs on one or both of the Matadero Creek Trails, or (ii) the likelihood of continued occurrences of property damage or personal injury as a result of the continued presence of dogs on one or both of the Matadero Creek Trails based on documented occurrences of property damage or personal injury. Before adopting additional requirements or prohibition of dogs, the County Executive will:

(1) Post a notice of intent to adopt a rule pursuant to this section B32-15 at several prominent locations on the Matadero Creek Trails, on the County's web site, and in a newspaper of general circulation in the County. The notice of intent will advise where the public may provide comment for or against the proposed rule and the period of time for comment, which shall not be fewer than 60 days from the date the notice of intent is posted.

(2) File any revised rule with the Clerk of the Board, along with findings that support the adopted rule, and post the revised rule at prominent locations on the affected Matadero Creek Trail.

Sec. B32-16. - Noise.

No person shall willfully make, or continue or cause to be made or continued, any loud, unnecessary noise that disturbs the peace or quiet of the Matadero Creek Trails or that causes discomfort or annoyance to any reasonable person of normal sensitivity.
