Sec. B39-1. - Use.¶
(a) Official Seal of the County. The official seal of the County ("County Seal") may be used by the County and the County's departments and agencies for official business of the County and by any person for non-commercial uses authorized by the Board of Supervisors or the County Executive. Commercial uses of the County Seal may only be authorized by the Board of Supervisors pursuant to Division A36.
(b) Official Seal of the Board of Supervisors. The official seal of the Board of Supervisors ("Board Seal") may be used by the Board of Supervisors, any member of the Board of Supervisors, the County Executive, or the Clerk of the Board of Supervisors for official business of the Board of Supervisors, and by any person for those matters authorized by the Board of Supervisors, any member of the Board of Supervisors, the County Executive, or the Clerk of the Board of Supervisors. Commercial uses of the Board Seal are prohibited.
(c) [Use restrictions.] The County Seal and Board Seal may not be used for the endorsement or disapproval of religion or for religious purposes, or for campaign purposes or events that influence or attempt to influence the action of the voters for or against the nomination or election of a candidate or candidates, or the qualification or passage of any measure.
(d) [Exceptions.] Notwithstanding subsections (b) and (c), a member of the Board of Supervisors may use the Board Seal solely as a means of identification if used in a context that makes clear that the material bearing the Board Seal is not an official statement of the Board of Supervisors.

Sec. B39-2. - Design.¶
(a) The color version of the design of County Seal shall correspond with the following representation:

Sec. B39-3. - Improper use.¶
No person shall use or distribute any reproduction or facsimile of the County Seal or Board Seal, or any symbol or design that imitates or which may be mistaken for such seals, except as authorized by Section B39-1 or Division A36. Any violation of this Section shall be an infraction for which the County may seek civil and administrative remedies as provided in Section B39-4. A separate violation occurs on each occasion the violation is committed and on each day during which the violation continues to exist.

Sec. B39-4. - Remedies.¶
(a) Administrative Remedy. In addition to the civil remedy authorized by subsection (b), any person who violates this Division may be subject to any of the administrative remedies set forth in Division A37 of this Code and shall be liable for each violation as follows:
(1) $100.00 per violation for a first violation within a 12-month period;
(2) $200.00 per violation for a second violation within a 12-month period; and
(3) $500.00 per violation for each additional violation within a 12-month period.
(b) Civil Remedy. The County Counsel may bring a civil action against any person who has violated or is violating any provision of this Division. Any person determined by a court to have violated this Division may be subject to civil penalties in the amounts established by Section B39-4(a) and any other relief ordered by the court.

Sec. B39-5. - Enforcement.¶
This Division may be enforced in any manner consistent with this Division by the County Executive or the County Counsel.

Sec. B39-6. - No conflict with state or federal law.¶
This Division shall be construed and applied so as not to conflict with applicable federal or state laws.
