Editor's note— Section 1 of Ord. No. NS-300.803, adopted Nov. 3, 2009, repealed Art. 2, which consisted of §§ A18-8—A18-17, pertained to Santa Clara Valley Public Health Department, and derived from Ord. No. NS-300.597, adopted May 13, 1997; Ord. No. NS-517.72, adopted April 15, 2003; and Ord. No. NS-300.710, adopted June 3, 2003. Section 3 of Ord. No. NS-300.803 renumbered Art. 3, §§ A18-18—A18-24 as Art. 2, §§ A18-8—A18-14. Subsequently, Sec. 3 of Ord. No. NS-300.968, adopted December 6, 2022, changed the title of Art. 2 from Santa Clara Valley Mental Health Department, to County of Santa Clara Valley Behavioral Health Services Department.

Sec. A18-8. - Recognition of the County of Santa Clara Behavioral Health Services…

There is in the CSCHS the County of Santa Clara Behavioral Health Services Department and the position of Director of Behavioral Health Services. The Director of Behavioral Health Services is appointed by and supervised by the County Executive in accordance with the provisions of the Charter and this Code.

Sec. A18-9. - Powers and duties of Director of Behavioral Health Services.

The Director of Behavioral Health shall be responsible for the delivery of mental health and substance use services for those served by the County and shall perform such other duties as set forth in state and federal law and as authorized by the Executive Director. The Director is expected to assure that proper personnel, equipment, supplies, and facilities are provided to carry out these prescribed functions. The Director shall determine and transmit the needs of the Department to the Executive Director of CSCHS and the County Executive.

Sec. A18-10. - Administration of admission and discharge policies.

The Director shall administer the policies of the County relative to admission and discharge of patients.

Sec. A18-11. - Records required; confidential nature.

The Director shall maintain complete records of all persons admitted to or treated by the Department. Such records shall be confidential, and their contents may be released only in accordance with proper legal authority.

Sec. A18-12. - Director responsible for professional training program.

The Director is responsible for the organization and the conduct of the professional training program by the Department.
