Sec. B32-1. - Purpose.¶
This division governs the use of trails that the Board of Trustees of the Leland Stanford Junior University ("Stanford") established pursuant to the Grant of Trail Easement and Agreement S1-C Alignment accepted by the County of Santa Clara. The land surrounding the trails remains private property and is not subject to this division; unauthorized access to the private property surrounding the Trails remains subject to the laws of trespass. The County's purpose in adopting these provisions is to ensure the safe use of the Trails by diverse users.

Sec. B32-2. - Definitions.¶
For the purposes of this division, the words and phrases set forth in this section shall have the meanings given them in this section.
(1) Agreement means the Grant of Trail Easement and Agreement S1-C Alignment accepted by the County of Santa Clara recorded in the land records of the County of Santa Clara.
(2) Matadero Creek Pedestrian Trail means the trail following an overland route between the southeasterly corner of the intersection of Page Mill and Deer Creek roads and the C-2 trail at a point northerly of the intersection of Arastradero Road and Interstate 280 and connecting into the 'a' segment of the S-l Route to the North and the C2 Adobe Creek trail to the southeast, as more particularly described in the recorded Agreement as segment 'b' of the "S-1 Route."
(3) Matadero Creek Multi-Use Trail means the trail located adjacent to Page Mill Road from the southeast intersection of Junipero Serra Boulevard, to the northeast intersection of Deer Creek Road, as more particularly described in the recorded Agreement as segment 'a' of the "S-1 Route."
(4) Matadero Creek Trails means collectively the "Matadero Creek Pedestrian Trail" and the "Matadero Creek Multi-Use Trail."

Sec. B32-3. - Violations and enforcement.¶
Violations of any provision of Division B32 are subject to enforcement and appeal using the procedure set forth in Division A37 of the County of Santa Clara's Ordinance Code. Upon an Enforcement Officer's determination of a violation of any of the mandatory requirements of this division, an Enforcement Officer shall have the authority to issue an administrative citation that will serve as the Notice of Violation and Notice of Administrative Fine required under Division A37. There will be no correction period for a Notice of Violation issued under this Division. Violations are also subject to enforcement as civil infractions.
Each violation and each separate offense designated by this Code shall be subject to fine as follows:
(1) $100.00 for the first violation;
(2) $200.00 for a second violation of the same ordinance section within one year;
(3) $500.00 for each additional violation of the same ordinance section within one year.

Sec. B32-4. - Trail hours.¶
(a) Establishment. The Matadero Creek Trails are generally open to the public between sunrise and sunset. Notice of such hours, which may be seasonally adjusted by the County Executive or designee, shall be conspicuously posted at the entrance to the Matadero Creek Trails.
(b) Temporary closures. The Matadero Creek Trails may be temporarily closed to the public during normal hours at the direction of the County Executive or designee for emergencies, maintenance or public safety. Notices of any temporary closure will be conspicuously posted at the entrance to the Matadero Creek Trails.
(c) Entering, remaining after hours. No person shall enter or remain within or on the Matadero Creek Trails during those hours of the day or night when they are closed to the public.
(d) County inspection and access. The County may have access to the Matadero Creek Trails for any purpose at any time, including, but not limited to, any period of closure directed under this division or the recorded Agreement.
