§ 18.82.010. Issuance of Permits.

All officials and public employees of the City vested with the duty or authority to issue permits shall conform to the provisions of this title, and shall issue no permit, certificate, or license for uses, buildings or purposes in conflict with the provisions of the ordinance codified in this title. Any such permit, certificate or license issued in conflict with the provisions of the ordinance codified in this title, intentionally or otherwise, shall be null and void. It shall be the duty of the building inspector and the City administrator to enforce the provisions of this title pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building or structure and the use of any land, building or premises.

§ 18.82.020. Violations Unlawful.

Any building or structure set up, erected, constructed, altered, enlarged, converted, moved or maintained contrary to the provisions of this title, and any use of land, building or premises established, conducted, operated or maintained contrary to the provisions of this title, shall be and the same is declared to be unlawful and a public nuisance. The City Attorney shall, upon order of the Council, immediately commence action or proceedings for the abatement and removal and enjoinment thereof in the manner provided by law, and shall take such other steps and shall apply to such courts as may have jurisdiction to grant such relief as will abate and remove such building or structure, and restrain and enjoin any person, firm, or corporation from setting up, erecting, building, maintaining or using any such building, structure or property contrary to the provisions of this title. The remedies provided for herein shall be cumulative and not exclusive. (Ord. 84-1 §37-2)

§ 18.82.030. Penalties.

  • A. Violations.

    1. Any violation of a term, condition, or the approved plans and specifications of any permit issued pursuant to this title shall constitute a violation.

    2. Each and every day during any portion of which any violation is committed, continued, or allowed to continue shall be a separate offense.

  • B. Remedies. In addition to the revocation and suspension provisions in this article and any available remedies under the law, the following remedies shall be available to the City or other enforcement agency regarding violations of this article.

    1. Administrative enforcement pursuant to this Municipal Code.

    2. Civil enforcement pursuant to this Municipal Code.

    3. Criminal enforcement as a misdemeanor, if allowed under state law.

  • C. City Council may, by resolution, adopt specific fines, fees, costs, and penalty amounts for violations and enforcement costs related to this article.
