27.10.010 REVOCATION OF PLANNING APPROVALS.

In addition to any other remedies established by the Code, in the event any person utilizing a planning application approval violates its terms or fails to comply with its conditions, or violates

the provisions of this code in effect at the time approval was granted, or directly or indirectly conducts, carries on, or allows to be conducted or carried on such violations, the Planning Commission shall have the power to permanently revoke or suspend the planning application approval as hereinafter provided.

27.10.020 REVOCATION PROCEDURES.

(a) No planning application approval shall be permanently revoked or suspended until a hearing is held by the Planning Commission. Written notice of such hearing shall be served upon the property owner, applicant, and occupant of the premises either personally or by certified mail. Notice shall be given to all property owners within a three-hundred-foot radius of the exterior boundaries of the subject property in the manner provided in Section 27.08.050. Such notice shall be given at least ten calendar days prior to the date set for hearing and shall state:

(1) The alleged violation(s);

(2) The date, time and place the hearing is to be held.

(b) At the hearing the property owner, applicant, and occupant shall be given the opportunity to be heard in person or through their representative(s), and may call witnesses and present evidence on their behalf. Additionally, the commission may hear such other testimony as it deems appropriate.

(c) Upon the conclusion of the hearing, the commission shall determine whether or not the approval shall be suspended, revoked, modified or left unaltered. The commission shall be authorized to grant time to correct the violation(s). Any person may appeal the action of the commission to the City Council in accord with the provisions of Section 27.08.070. Notice of the hearing before the Council shall be given in the manner provided in this section for hearings before the commission.

(d) In any case where a planning application approval is revoked, no new approval may be granted to any person to conduct or carry on the same or similar activity on the subject property until all conditions of the approval are met.

27.10.030 APPLICATIONS FOR BUILDING PERMITS AND BUSINESS PERMITS.

The zoning administrator shall review all applications for building permits and business permits and business tax return names and addresses to determine whether a proposed building or structure, or use, or business is in compliance with this title. No building permit shall be issued authorizing work upon property for which a planning application is being processed unless such work is unrelated to the planning application and/or a delay in work poses an immediate threat to the health and safety of the premises or the occupants thereof. No building permit or business permit shall be issued until the zoning administrator shall have approved such application by stamping or affixing his or her written approval on such application.

27.10.035 APPLICATIONS FOR DEMOLITION PERMITS.

Demolition permits shall not be issued unless the requirements set forth in Section 23.06.035 are met.

27.10.040 CERTIFICATE OF OCCUPANCY APPROVAL.

No new building for which a planning application is required may be occupied after completion of its construction, alteration, or addition until the certificate of occupancy to be issued by the building official is approved in writing by the zoning administrator or designee.
