2-2351 - PERMITTED SERVICES.

Within the limitations of his personnel, the Sheriff-Public Administrator may render the following services and collect the following amounts therefore:

(a) Clearance letters: Includes the researching of Sheriff's records databases for law enforcement documented reports and contact information related to the requestor, preparation of a letter indicating the record information sought, and release of this letter to the requestor. Fee set by Board Resolution.

(b) Fingerprints: Taking the print impressions of the appendages of both hands on fingerprint cards or through the automated Livescan system for submission to the Automated Fingerprint Identification System. Fee set by Board Resolution.

(c) Reports: Copies of reports, or a portion of a report, approved for release by the Sheriff-Public Administrator. Fee set by Board Resolution.

2-2352 - EXEMPTION FROM FEES.

No fee shall be charged by the Sheriff-Public Administrator for the taking of fingerprints, furnishing of records or information in the following instances:

(a) Where exemption is provided for by Chapter 2 of Division 7 of Title 1 of the Government Code.

(b) For any criminal matter.

2-2353 - RECRUITMENT AND TRAINING.

While receiving any State Aid pursuant to Article 3, Chapter 5, Title 7, Part 3, of the Penal Code of the State of California, commencing with Section 6040, the County of San Joaquin will adhere to the standards for recruitment and training established by the Board of Corrections.

2-2354 - REMOVAL AND CUSTODY FEE.

(a) The Office of the Medical Examiner, whenever it takes custody of a dead body pursuant to law, shall charge and collect from the person entitled to control the disposition of the remains fees set by Board Resolution. These fees shall not be imposed in the following circumstances:

(1) Upon a person who claims and proves to be indigent. This claim shall be submitted to and decided by the Office of the Medical Examiner.

(2) In cases in which the body is that of a child not more than fourteen (14) years of age.

(3) In cases in which the Office of the Medical Examiner ascribes the death to the criminal act of another, unless the Office of the Medical Examiner has reasonable grounds to believe that the deceased was involved in criminal activity which contributed to his or her own death.

(4) In cases in which the Office of the Medical Examiner takes custody of a body over the objection of the person entitled to control its disposition and the Office of the Medical Examiner later determines, at the Office of the Medical Examiner's sole discretion, that it was not necessary to take custody of the body.

(b) These fees, if not paid, may be considered a part of the funeral expenses and paid as a preferred charge against the estate of the decedent.
