No person may file pursuant to this Chapter an appeal of the following matters:
(a) A decision concerning the same issue or issues at the same property that was finally decided by the Commission within the previous twelve (12) months; and
(b) A decision made by the Commission when it was sitting as the Abatement Appeals Board.
