Sec. 74-146. - Required.¶
It shall be unlawful to make or to cause or to permit to be made any excavation in or under the surface of any public street, alley, sidewalk or other public place for the installation, repair or removal of any pole, tank, pipe, conduit, duct or tunnel or for any other purpose without first obtaining from the department of public works a written permit to make such excavations.

Sec. 74-147. - Application generally.¶
A written application for the permit required by section 74-146 shall be made and filed with the department of public works. Such application shall set forth the name and residence or business address of the person making such application, shall state in detail the location and area of each excavation intended to be made and shall state the purpose for which the excavation is to be made and used.

Sec. 74-148. - Plat.¶
With the application mentioned in section 74-147, there shall be submitted a plat in duplicate showing the location of each proposed excavation, the dimensions thereof and such other details as the department of public works may require. However, the filing of plats shall not be required when excavations are made for the location of trouble or leaks in conduits or pipes or for the making of repairs thereto.

Sec. 74-149. - Approval and filing of application and plat.¶
When the application for a permit to excavate required by section 74-147 of this division and the details shown upon the accompanying duplicate plats, when such plats are required, comply with the terms of this article, the application and duplicate plat shall be approved by the city engineer. Such application, together with any required duplicate plat, shall be filed with the department of public works.

Sec. 74-150. - Deposit to cover city expense required.¶
Every person desiring a permit required by section 74-146 shall make a deposit as outlined in section 74-151 to cover the cost of inspection and of restoring such public street, alley, sidewalk or other public place to its original condition, together with the incidental expenses in connection therewith, as provided by this article.

Sec. 74-151. - Special deposit.¶
At the time of filing data with the department of public works as provided by section 74-149 of this division, the applicant for the permit required by this division shall make a special deposit with the department of public works in such amount as established from time to time by resolution of the city council.

Sec. 74-152. - General deposit.¶
Any person intending to make any excavation in any public street, alley or other public place may make and maintain with the department of public works a deposit in such amount as shall be established from time to time by resolution of the city council. Such general deposit shall be used for the same purpose as the special deposit described in section 74-151. As long as such general deposit is maintained, the depositor shall not be required to make the special deposit, but shall be required to file duplicate plats showing the location thereof, as provided in section 74-148 of this division, and to comply with all other sections of this Code.

Sec. 74-153. - Legal authority of applicants.¶
Each applicant for a permit required by section 74-146 of this division shall, before the department of public works may issue such permit, show to the satisfaction of the department that the applicant has legal authority to occupy and use, for the purpose mentioned in the application, the streets, alleys, sidewalks or other public places covered by the application.

Sec. 74-154. - Issuance or denial.¶
Upon receiving a written application, as provided in section 74-146, and one of the duplicate plats, when such plats are required, each bearing the approval of the city engineer, and the general or special deposit required by sections 74-150 and 74-151, the department of public works shall issue a written permit to make such excavation and shall open and keep an account thereof.

Sec. 74-155. - Contents; transferability.¶
Each permit issued pursuant to section 75-154 shall state whether the work to be done is covered by a general or a special deposit, and if a special deposit shall state the amount thereof and shall be a receipt therefor. It shall also specify the person to whom the permit is issued; the street, alley or other public place and the particular portion thereof to be excavated; and the extent of such excavation. No permit issued under section 74-154 of this division shall be transferable.

Sec. 74-156. - Cancellation.¶
(a) If the work of excavation is not commenced within 90 days from the date of issuance of a permit therefor issued under section 74-154 of this division or is not diligently prosecuted, such permit shall be cancelled and the city shall retain a fee as follows:
(1) For a permit fee up to $100.00: $25.00.
(2) For a permit fee over $100.00: 25 percent of permit fee.
(b) Such retention shall be made from the general or special deposit made by the person to whom the permit is issued.

Sec. 74-157. - Preservation of rights.¶
Every permit for an excavation in or under the surface of any public street, alley or other public place shall be granted subject to the right of the city or of any other person entitled thereto to use that part of such street, alley or other public place for any purpose for which such street, alley or other public place may lawfully be used.
