SEC. 72.100. ROAD COMMISSIONER TO ERECT STOP SIGNS ON THROUGH HIGHWAYS.

The Road Commissioner shall erect and maintain stop signs complying with the provisions of the Vehicle Code at all entrances to highways or portions of highways designated by the Board by resolutions as "through highways."

SEC. 72.101. ESTABLISHMENT OF STOP SIGNS AT STOP INTERSECTIONS.

The Road Commissioner shall erect and maintain stop signs in compliance with the provisions of the Vehicle Code at the entrance to every intersection where a Civil or Traffic Engineer licensed by the State of California has determined traffic safety and/or intersectional operation will be enhanced, the proposed stop control shall be supported by a safe approach speed of less than 5 MPH and the Community Planning/Sponsor Group (where applicable). If there is opposition to the proposed stop control, the matter will be reviewed by the San Diego County Traffic Advisory Committee as a full item and a recommendation will be submitted to the Board. The Board can then determine if there is special hazard to life or property by reason of the volume of traffic at such intersection, or because of the lack of visibility to the drivers of vehicles approaching such intersection, or because of the number of reported accidents or the apparent probability thereof, or by reasons of physical conditions which render any such intersection exceptionally dangerous or hazardous to life or property, and where the factors creating this special hazard are such that according to the principles and experience of traffic engineering, the installation of stop signs is reasonably calculated to reduce the expectancy of accidents and that the use of warning signs would be inadequate.

SEC. 72.102. EMERGENCY STOP SIGNS.

Where because of any emergency the conditions described in Section72.101 exist, the Road Commissioner may erect or cause to be erected stop signs complying with the Vehicle Code, as provided in Section 72.101, and maintain such signs while such conditions continue to exist.

SEC. 72.103. ALL VEHICLES TO STOP AT STOP SIGNS.

Where stop signs are erected as herein provided at or near the entrance to any intersection every operator of a vehicle shall stop such vehicle at such sign or at a clearly marked stop line before entering the intersections; provided, however, that no stop need be made at any such entrance or intersection where:

(a) An officer is on duty and directs traffic to proceed.

(b) A traffic signal is in operation and indicates that traffic may proceed.

(c) A stop sign has been removed or covered pursuant to this division.

SEC. 72.104. EMERGENCY REMOVAL OF STOP SIGNS.

Where, because of temporary detours, or other emergency it would be impractical and a hazard to require a vehicle to stop at an intersection where a stop sign has been erected pursuant to this division and the Road Commissioner so finds, he shall either remove such sign or so cover it that no portion of the word "STOP" remains visible.

At the termination of such emergency, unless the Board otherwise determines, the Road Commissioner shall restore such signs or uncover such signs.

SEC. 72.105. EMERGING FROM ALLEY OR PRIVATE DRIVEWAY.

The driver of a vehicle emerging from an alley, driveway or building, shall stop such vehicle immediately prior to driving onto a sidewalk or into the sidewalk area extending across any alleyway.

SEC. 72.107. ROAD COMMISSIONER TO ERECT SIGNS AT YIELD RIGHT-OF-WAY INTERSECTIONS.

The Road Commissioner shall erect and maintain "Yield Right-of-Way" signs complying with the provisions of the Vehicle Code to all approaches to highways and intersections of highways where a Civil or Traffic Engineer licensed by the State of California has determined traffic safety and/or intersectional operation will be enhanced, the proposed yield control shall be supported by a safe approach speed of less than 15 MPH and the Community Planning/Sponsor Group (where applicable). If there is opposition to the proposed yield control, the matter will be reviewed by the San Diego County Traffic Advisory Committee as a full item and a recommendation will be submitted to the Board. The Road Commissioner shall also erect and maintain "Yield Right-of-Way" signs when designated by the Board by resolution.

[ARTICLE 7.] STOPPING, STANDING AND PARKING

SEC. 72.110. APPLICATION OF REGULATIONS.

(a) The provisions of this division prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.

(b) The provisions of this division imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the Vehicle Code, this code or County ordinances, prohibiting or limiting the standing or parking of vehicles in specified places or at specified times.

SEC. 72.111. STANDING PROHIBITED.

No person shall stop, stand or park a vehicle within any median strip between roadways or within any traffic island or other area designed to separate or guide the movement of traffic.

SEC. 72.112. PARKING PARALLEL WITH CURB.

(a) Subject to other and more restrictive limitations, a vehicle may be stopped or parked within 18 inches of the left-hand curb facing in the direction of traffic movement upon any one-way street unless signs are in place prohibiting such stopping or standing.

(b) In the event a highway includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon or adjacent to the left-hand side of such one-way roadway unless signs are in place permitting such standing or parking.

(c) The Road Commissioner is authorized to determine when standing or parking shall be prohibited upon the left-hand side of any one-way street or when standing or parking may be permitted upon or adjacent to the left-hand side of any one- way roadway of a highway having two or more separate roadways and shall erect signs giving notice thereof.

(d) No person shall stop, stand or park a vehicle upon either side of a one-way street so that such vehicle is facing opposite to the direction of traffic movement upon such one-way street.

SEC. 72.113. PARKING PROHIBITED ON NARROW STREETS.

(a) The Road Commissioner is hereby authorized to place signs or markings indicating no parking upon any highway when the width of the roadway and shoulders of such highway does not exceed 20 feet, or upon one side of a highway as indicated by such signs or markings when the width of the roadway and shoulders of such highway does not exceed 30 feet.

(b) When signs or markings prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any sign or marking.

SEC. 72.114. PARKING ADJACENT TO SCHOOLS.

(a) The Road Commissioner is hereby authorized to erect signs indicating no parking upon that side of any street

adjacent to any school property when such parking would, in his opinion, interfere with traffic or create a hazardous situation.

(b) When official signs are erected indicating no parking upon that side of a street adjacent to any school property, no person shall park a vehicle in any such designated place.

SEC. 72.115. STOPPING OR STANDING PROHIBITED IN SPECIFIED PLACES.

When the Road Commissioner determines that it is necessary to prohibit stopping, standing or parking at any of the following places in order to eliminate a dangerous traffic hazard, the Road Commissioner shall appropriately sign or mark such places and when so signed or marked no person shall stop, stand or park a vehicle in any of said places, except that this section does not prohibit busses from stopping to receive or discharge passengers at such places when appropriately signed or marked as bus loading zones:

(a) At any place within 20 feet of a point on the curb or edge of the roadway immediately opposite the mid-block end of a safety zone.

(b) At any place within 25 feet of an intersection.

(c) Within 25 feet of the approach to any traffic signal, stop sign, or official electric flashing device.

(d) Adjacent to either side of a crosswalk or driveway entrance for a distance not to exceed 20 feet from either side of such crosswalk or driveway.

(e) At any other place where the Road Commissioner determines that it is necessary in order to eliminate a dangerous traffic hazard.

(f) Or any other location where the Road Commissioner and a Civil or Traffic Engineer licensed by the State of California believes traffic safety and/or roadway operation is enhanced with the installation of an appropriate parking prohibition and the proposed parking prohibition shall be supported by the adjacent property owner(s) and Community Planning/Sponsor Group (where applicable).

If there is opposition to the proposed parking prohibition, the matter will be reviewed by the San Diego County Traffic Advisory Committee as a full item.

SEC. 72.116. STOPPING OR PARKING PROHIBITED IN SPECIFIED PLACES.

The Road Commissioner may appropriately sign or mark the following places and when so signed or marked no person shall stop, stand or park a vehicle in any of said places:

(a) For a distance of 50 feet along the curb or edge of the roadway at the entrance to any hospital.

(b) For a distance of 50 feet along the curb or edge of the roadway immediately in front of the main entrance to any substation office of the Sheriff.

(c) For a distance of 50 feet along the curb or edge of the roadway immediately in front of the main entrance to any fire station housing motor vehicle fire-fighting equipment.

(d) Adjacent to any fire hydrant when it has been determined by the Road Commissioner that stopping, standing or parking of any vehicle, whether attended or unattended, would present some special hazard or would prevent ready access to the fire hydrant.

SEC. 72.117. BOARD MAY PROHIBIT OR RESTRICT PARKING.

When the Board determines by resolution that it is necessary to prohibit stopping, standing or parking on certain highways, or portions thereof, at all or certain hours of the day, in order to facilitate the movement of traffic or to eliminate a hazardous condition, the Road Commissioner shall appropriately sign or mark such highways, or portions thereof, and when so signed or marked, no person shall stop, stand or park a vehicle on any such highway or portion thereof in violation of the restrictions stated on or indicated by such signs or markings, except that this section does not prohibit busses from stopping to receive and discharge passengers at places appropriately signed or marked as bus loading zones.

SEC. 72.118. BLOCKING HIGHWAY.

It shall be unlawful for any person to stop, park, or leave standing any vehicle, whether attended or unattended, upon any highway within any business or residence district unless not less than eight feet of the width of the paved or improved or main traveled portion of the highway opposite such stopped, parked, or standing vehicle is left clear and unobstructed for the free passage of other vehicles.

SEC. 72.119. TEMPORARY NO PARKING.

(a) Whenever the Road Commissioner shall determine that traffic congestion or traffic hazard of an emergency nature is likely to result from the operation, stopping, standing, or parking of vehicles during the holding of public or private assemblages, gatherings, or functions, or during the construction, alteration, repair or improvement of any highway, or for any other reason, he may place or cause to be placed, temporary signs prohibiting the operation, stopping, standing, or parking of vehicles during the existence of such emergency.

(b) When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, stop, stand or park any vehicle contrary to the directions of such signs.

SEC. 72.120. MOVING OF VEHICLES BY SHERIFF.

If a person parks any vehicle contrary to the provisions of Section72.119 and the presence of such vehicle prevents or interferes with the construction, alteration, repair or improvement of the highway, the Sheriff shall move such vehicle to the nearest place on the highway where:

(a) The presence of such vehicle will not prevent or interfere with the construction, alteration, repair or improvement of the highway, and

(b) The presence of such vehicle is not in violation of any provisions of any statute or ordinance, or is not in violation of any statute or ordinance except Section 72.119.

The Sheriff shall not move, in any event, any vehicle more than 500 feet.

SEC. 72.121. REMOVAL OF IGNITION KEY WHEN PARKING.

Every person who parks a motor vehicle upon any highway shall first lock the ignition, remove the key therefrom and take such key with him, unless a licensed operator remains in such motor vehicle, in which case such licensed operator before leaving such vehicle shall first lock the ignition, remove the key therefrom and take such key with him.

SEC. 72.122. USE OF STREETS FOR STORAGE OF VEHICLES PROHIBITED.

(a) No person who owns or has possession, custody or control of any vehicle shall park such vehicle upon any street or alley for more than a consecutive period of 72 hours. A vehicle shall be considered to have been parked for a consecutive period of 72 hours if it has not been moved at least five tenths (0.5) of a mile from its original parked (stopped) location within the preceding 72 hour period.

(b) In the event a vehicle is parked upon a street in excess of a consecutive period of 72 hours in violation of this section, the Sheriff or any member of the Highway Patrol of the State of California may remove said vehicle from the street in the manner and subject to the requirements of Sections 22651 and 22652 of the Vehicle Code.

SEC. 72.123. PARKING FOR CERTAIN PURPOSES PROHIBITED.

No person shall park a vehicle upon any highway for the principal purpose of:

(a) Displaying such vehicle for sale. A vehicle shall not be considered to be displayed for sale when it is parked upon any highway if the vehicle contains a for sale sign not greater than eight and one-half inches (8½") by eleven inches (11") and the sign is placed on a side window, and the vehicle is not parked within 500 feet of other vehicles advertised for sale.

(b) Washing, greasing, or repairing such vehicle except repairs necessitated by an emergency.

SEC. 72.124. BOARD MAY RESTRICT PARKING TO EMERGENCY VEHICLES.

The Road Commissioner shall locate and establish restricted parking on certain highways or portions thereof to emergency vehicles as defined in Vehicle Code Section 165, or to one or more of the types of emergency vehicles as defined therein, where a Civil or Traffic Engineer licensed by the State of California has determined traffic safety and/or roadway operation will be enhanced and the proposed installation shall be supported by the adjacent property owner(s) and Community Planning/Sponsor Group (where applicable). If there is opposition to the proposed installation, the matter will be reviewed by the San Diego County Traffic Advisory Committee as a full item and a recommendation will be submitted to the Board.

When the Board determines by resolution that it is necessary to restrict parking on certain highways or portions thereof to emergency vehicles as defined in Vehicle Code Section 165, or to one or more of the types of emergency vehicles as defined therein, the County engineer shall appropriately sign or mark such highways or portions thereof, and when so signed or marked no person shall stop, stand or park a vehicle on any such highway or portion thereof in violation of the restriction stated on or indicated by such signs or markings.

SEC. 72.125. BOARD MAY ESTABLISH NO PARKING-TOW AWAY ZONES.

(a) When the Board determines by resolution that it is necessary to establish no parking-tow away zones on certain highways or portions thereof as defined in Vehicle Code Section 22651 subparagraphs (k), (l), (m), or (n), the Road Commissioner shall appropriately sign or mark such highways or portions thereof, and when so signed or marked no person shall stop, stand or park a vehicle on any such highway or portion thereof in violation of the restriction stated on or indicated by such signs or markings.

SEC. 72.126. PARKING OR STANDING OF COMMERCIAL VEHICLES.

(a) The parking or standing on streets in residential areas of commercial vehicles having a manufacturer's gross weight rating of 10,000 pounds or more is hereby prohibited.

(b) This ordinance shall not apply under the following conditions:

(1) When such vehicle is loading or unloading property.

(2) When such vehicle is parked in connection with and in aid of the performance of a service to or on a property within

the residential area.

(3) When such vehicle is engaged in the construction, installation, repair or maintenance of a publicly or privately

owned utility facility located within the residential area.

(4) When the area contains property used for commercial or industrial purposes and such vehicle is parked on the

property or on the highway contiguous to the commercial/ industrial property.

(5) When the Board of Supervisors has determined by resolution that the parking of such vehicles on certain residential

streets or portions thereof shall be permitted and the Road Commissioner has appropriately signed or marked such streets or portions thereof.

(c) For purposes of this ordinance a residential area shall be defined as that portion of a highway and the property contiguous thereto on one or both sides of which highway, the contiguous property is occupied by a residential dwelling unit (single or multi-family dwelling units, including apartments or condominiums).

SEC. 72.127. STOPPING OR STANDING OF A SCHOOL BUS BY A DRIVEWAY.

The stopping of a school bus in front of a public or private driveway for the sole purpose of loading or unloading school pupils is authorized.
