10.40.010 - Parking meter zones established; hours of operation; parking fee.

The following City of San Clemente parking meter zones are hereby established to control the parking of vehicles with the aid of parking meters or other parking control devices (pay station) on certain City-owned property:

A. North Beach parking meter zone.

  1. The following streets, portions of streets and off-street parking lots are included in the North Beach parking meter zone:

(a) Boca de la Playa, both sides, from cul-de-sac to Calle Deshecha;

(b) Calle Deshecha, south side, between Avenida Estacion and Avenida Pico, and both sides between Avenida Pico and Boca de la Playa;

(c) Avenida Estacion, west side, from Calle Deshecha to the mobile home park entrance;

(d) Avenida Estacion, both sides, from Calle Deshecha to its southern terminus;

(e) Avenida Pico, both sides, between El Camino Real and Boca de la Playa; and

(f) North Beach parking lot.

  1. Hours of Operation:

(a) On-street parking spaces — 9:00 a.m. to 10:00 p.m.;

(b) Off-street parking lot — 9:00 a.m. to 10:00 p.m.

  1. Parking fee:

(a) Except as provided in subsections (b) and (c) below, $0.25 for each ten-minute period or $1.50 for each one-hour period; and

(b) Designated commuter/recreational parking spaces in North Beach off-street parking lot: the parking meter fee for designated commuter/recreational parking spaces in the North Beach parking lot shall be $1.00 per day, Monday through Friday, excluding holidays, provided parking and payment occurs between the hours of 4:30 a.m. and 9:00 a.m. In lieu of cash payment, use of the annual metered parking permit issued pursuant to Section 10.28.260 is honored in all parking spaces in the North Beach parking lot at all times. For purposes of this section, "designated commuter/recreational parking spaces" shall mean parking spaces numbered as five through 147.

(c) Calle Deshecha, south side, between Avenida Estacion and Avenida Pico:

(i) Monday through Friday, excluding holidays, between the hours of 9:00 a.m. and 10:00 p.m.: two hours free parking, then $0.25 for each ten-minute period or $1.50 for each one-hour period.

(ii) All other times: $0.25 for each ten-minute period or $1.50 for each one-hour period.

B. Linda Lane Park parking meter zone.

  1. The following streets, portions of streets, and off-street parking lots are included in the Linda Lane Park parking meter zone:

(a) Linda Lane from Encino Lane to its terminus;

(b) Via Mecha from West Marquita to Linda Lane; and

(c) Linda Lane parking lot.

  1. Hours of Operation: 9:00 a.m. to 10:00 p.m.

  2. Parking fee: $0.25 for each ten-minute period of $1.50 for each one-hour period.

C. Pier Bowl Area parking meter zone.

  1. The following streets, portions of streets and off-street parking lots are included in the Pier Bowl Area parking meter zone:

(a) Alameda Lane north, both sides, from Avenida Del Mar to Avenida Del Mar;

(b) Avenida Del Mar, both sides, from Avenida Granada to the northwest terminus of Avenida Victoria;

(c) Avenida Victoria, from its northwesterly terminus to 519 Avenida Victoria on the south side, and 514 Avenida Victoria on the north side;

(d) Lower Pier Bowl parking lot; and

(e) Upper Pier Bowl parking lot.

  1. Hours of Operation: 9:00 a.m. to 10:00 p.m.

  2. Parking fee: $0.25 for each ten-minute period or $1.50 for each one-hour period.

D. T-Street parking meter zone.

  1. The following streets and portions of streets are included in the T-Street parking meter zone:

(a) West Paseo de Cristobal, southwest side, from 354 West Paseo de Cristobal at the northwesterly curve of the cul-de-sac, southerly, to the first residential lot at 333 West Paseo de Cristobal.

  1. Hours of Operation: 9:00 a.m. to 10:00 p.m.

  2. Parking fee: $0.25 for each ten-minute period or $1.50 for each one-hour period.

E. Calafia parking meter zone.

  1. The following streets and portions of streets are included in the Calafia parking meter zone:

(a) Avenida Calafia, both sides, from approximately 65 feet west of the driveway at 210 Avenida Calafia, westerly to the Calafia Beach parking entrance.

(b) Hours of Operation: 24 hours per day.

(c) Fee: None.

F. Camino Capistrano parking meter zone.

  1. The following streets are included in the Camino Capistrano parking meter zone:

(a) Camino Capistrano, both sides, from El Camino Real to Avenida Vaquero.

  1. Hours of Operation: 24 hours per day.

  2. Fee: None.

10.40.015 - Use of parking spaces in parking meter zones.

Any parking space in parking meter zone, as established in Section 10.40.010, shall be used only for purposes of parking vehicles in a manner consistent with this title. Any other use is prohibited, unless otherwise provided by this code or by resolution of the City Council.

10.40.020 - Manner of installation—Removal.

A. .....The City Traffic Engineer shall cause parking meters or other parking control devices to be installed and maintained in all parking meter zones.

B. .....Parking meters shall be installed upon the curb or sidewalk area immediately adjacent to each parking space. Each meter shall be placed in such a manner so as to show or display by a sign or signal that the parking space adjacent thereto is or is not legally in use. In off-street parking lots, one or more other parking control devices (pay stations) may be installed in lieu of parking meters.

C. .....Each parking meter and other parking control device shall display the length of time that may be purchased for the accepted denomination of coin or bill. Furthermore, each parking meter shall contain a device which displays the allowable parking time remaining after the coin has been deposited therein. This display shall continue from the time the coin(s) is deposited in the parking meter until the purchased time expires. Each parking meter shall contain a device which indicates that, upon expiration of the purchased time, the allowed time for parking has expired. Each other parking control devise shall issue a printed receipt identifying the time at which the right to park in the parking space has expired.

D. .....The Traffic Engineer shall cause parking meters adjacent to undeveloped property to be removed or relocated once such meters or their corresponding parking spaces are shown to prohibit the only access to the property. Such a meter shall only be removed upon proof, to the satisfaction of the City Traffic Engineer, that the property owner or his or her agent has both obtained a valid building permit for the property, and that the parking meter or its corresponding parking space does in fact inhibit the only access thereto.

10.40.040 - Operation procedure.

Immediately after occupying a parking meter space, the operator of the vehicle shall deposit a coin of the United States in the parking meter and take such steps as are necessary to activate the unit which may include turning of a crank, knob or handle in accordance with the instructions posted on the face of the parking meter. Occupants of spaces in off-street lots shall immediately after occupancy of the parking space proceed to the parking control device and insert therein the coins or currency necessary to purchase the amount of parking time during which they desire to occupy the space.

10.40.060 - Unlawful to park after meter time has expired.

No operator of any vehicle shall permit such vehicle to remain parked in any parking space during any time that the meter is showing a signal indicating that such space is illegally in use other than such time immediately after the original occupancy as is necessary to operate the meter to show legal parking.

10.40.070 - Unlawful to extend time beyond limit.

No person shall follow the operational procedure or any part of the operational procedure for the purpose of increasing or extending the parking time of any vehicle beyond the legal parking time which has been established for the parking space adjacent to which the parking meter is placed.

10.40.080 - Improper use of meter.

No person shall deposit or cause to be deposited in any parking meter any defaced or bent coin, or any slug, device or metallic substitute for a coin of the United States, or deface, injure, tamper with, open or wilfully break, destroy or impair the usefulness of any parking meter.

10.40.090 - Deposit of coins in meter by unauthorized person.

No person, other than the owner or operator of a vehicle, shall deposit any coin in any parking meter without the knowledge or consent of such owner or operator of the vehicle using the parking space immediately adjacent to such meter.

10.40.100 - Bicycles, newsracks and other articles not to lean against parking meters.

No person shall attach anything to or allow a bicycle, newsrack or any other article or thing to lean against a parking meter or a parking meter standard.

10.40.110 - Rule of evidence.

The parking or standing of any motor vehicle in a parking space, at which space the parking meter displays the sign or signal indicating illegal parking, shall constitute a prima facie presumption that the vehicle has been parked or allowed to stand in such space for a period longer than permitted by this chapter.

10.40.120 - Use of money deposited in parking meters.

All moneys collected from parking meters in this City shall be placed in a special fund, which fund shall be devoted exclusively to the following purposes:

A. For the purchasing, leasing, installing, repairing, maintaining, operating, removing, regulating and policing of parking meters in this City, and for the payment of any and all expenses relating or incidental thereto;

B. For the purchasing, leasing, acquiring, improving, operating, and maintaining of off-street parking facilities in this City;

C. For the installation and maintenance of traffic-control devices and signals;

D. For the painting and marking of streets and curbs required for the direction of traffic and parking of motor vehicles;

E. For the proper regulation, control and inspection of parking and traffic upon the public streets;

F. To be pledged as security for the payment of principal and interest on off-street parking revenue bonds issued by this City, or any parking district organized within this City.
