10.64.010 - Application.

Unless otherwise specified, this chapter applies to the use and operation of skates and skateboards on all streets, alleys, sidewalks in the City, whether public or private, and all other property owned by the City.

As used in this chapter, the term "skates" shall include roller skates and in-line skates.

As used in this chapter, the term "skate court" shall mean a skate park or other similar facility in the City that the City specifically designates for the use of skates and skateboards and where said facility includes amenities that the City specifically designates for acrobatics.

10.64.020 - Use and operation.

A. .....Except as provided in this section, no person shall use or operate a skateboard on a public or private street or alley in the City if there is a sidewalk adjacent and parallel to the street. If no such sidewalk is present, skateboards may be operated in the street as far on the right-hand side of the roadway as is practicable, in the same direction as traffic.

B. .....No person shall use or operate a skateboard on the street or sidewalk within the 100 to 200 blocks of Avenida del Mar, on the Municipal Pier, on the paved area at the base of the pier within three hundred (300) feet of either side of the pier, and on the street or sidewalk on and along Del Mar from El Camino to the base of the pier and Victoria between Corona Lane and the base of the pier. Skateboarding shall be prohibited on all other public streets, sidewalks, rights-of-way, and all other public property as the City Council may from time to time designate by resolution.

C. .....No person shall use or operate a skateboard on any public or private street, alley or sidewalk, or right-of-way or on any property owned by the City in a manner which endangers the safety of any other person or property. No person using or operating a skateboard on a street, alley, sidewalk, right-of-way or any other property owned by the City shall pass a pedestrian at a distance closer than three (3) feet. If such a street, alley, sidewalk, right-of-way or public property is not sufficiently wide to allow the skateboarder to ride past the pedestrian while maintaining the three (3) foot distance, the skateboarder shall cease to operate the skateboard and walk past the pedestrian until such time as the skateboarder can maintain the three (3) foot distance.

D. .....No person shall use or operate a skateboard within twenty (20) feet of the entrance to any shop, store or commercial building while such shop, store or commercial building is open for business.

E. .....Skates or skateboards shall only be used or operated while such user is in the upright position, except when the skates or skateboard are used or operated at a skate court.

F. .....The use of ramps, jumps or any other device used to force or allow skates or a skateboard off the pavement is prohibited, except when such ramps, jumps, or devices are a part of a skate court.

G. .....No person shall perform acrobatics while operating skates or a skateboard, except at a skate court. Acrobatics shall include jumps, spins, loops, 360s, handstands, or any other movement or trick not essential to the ordinary use of skates or a skateboard as a transportation device.

H. .....No person shall use or operate a skateboard at a speed in excess of twenty (20) miles per hour.

I. .....No person shall use or operate a skateboard except during daylight hours and for a period of up to one-half (½) hour after sunset, unless such use or operation is within a skate court that is open and lighted for evening use. Hours of evening use shall be posted at the skate court.

10.64.030 - Use of skates or skateboards on school property.

No person shall use skates or a skateboard on the property of any school (whether public or private) that has displayed in plain view at all entrances to the school property a sign stating that skating or skateboarding is prohibited on the school property.

10.64.040 - Use of skates or skateboards on private property.

No person shall use or operate skates or a skateboard on any privately owned property, including any off-street parking facility, where there is displayed in plain view at the entrances to the property a sign stating that skating or skateboarding is prohibited on the property.

10.64.050 - Designated skate court areas.

A. .....The City Council may from time to time designate certain areas within the City for the use of skates and/or skateboards. Such areas shall be designated by resolution of the City Council.

B. .....Designated skate court areas shall be posted with signs which specify rules and regulations for use of the skate court.

C. .....All persons using a designated skate court for skating and skateboarding shall obey all rules and regulations posted at any skate court, which rules and regulations may include, but not be limited to, the following:

  1. Hours of operation.

  2. Skate courts shall be limited to the use of skates and skateboards. The use of bicycles on the skating surface shall be prohibited.

  3. No person shall use the designated skating and skateboarding areas without proper safety equipment including a helmet, elbow pads, and knee pads, and any person who fails to do so shall be guilty of an infraction under Section 10.64.060.

  4. No person shall use alcohol or drugs in the designated skating or skateboarding area.

The City's Director of Beaches, Parks and Recreation shall establish, and from time to time may revise, rules and regulations applicable to any skate court in addition to those provided in this Section 10.64.050.
