§ 7.52.010. Authority of police and fire department officials.

A. Except as provided in subsection B of this section, no person other than a police officer of the city or member of the fire department of the city shall direct or attempt to direct traffic by voice, hand, or other signal.

B. The provisions of subsection A of this section shall not apply to the following persons:

  1. Any person giving temporary or permanent appointment to regulate traffic by the chief of police or his or her authorized representative whenever traffic control devices are disabled or otherwise inoperable, at the scenes of accidents or disasters, or at such locations as may require traffic direction for orderly traffic control;

  2. Persons authorized to perform the duties of maintenance, construction, or repairs of streets, sidewalks, planter strips, and public utility facilities, where necessary to direct the orderly flow of traffic;

  3. Any person acting at the scene of an accident or disaster where necessary for the orderly and safe flow of traffic, where no police officer, member of the fire department or other person designated by the chief of police is at the scene.

§ 7.52.020. Exemption of certain vehicles.

A. The provisions of this title regulating the operation, parking, and standing of vehicles shall not apply to vehicles operated by the police or fire departments, any public ambulance or public utility vehicle or any private ambulance, which public utility vehicle or private ambulance has qualified as an authorized emergency vehicle, when any vehicle mentioned in this section is operated in the manner specified by the Vehicle Code in response to an emergency call. The foregoing exemptions shall not relieve the operator of any such vehicle from the obligation to exercise due care for the safety of others or the consequences of willful disregard for the safety of others.

B. The provisions of this title regulating the parking or standing of vehicles shall not apply to any vehicle of a city department or public utility while necessarily in use for construction or repair work or any vehicle owned or operated by the United States Postal Service while in use for the collection, transportation or delivery of United States mail.

§ 7.52.030. Emergency or disaster.

In cases of emergency or disaster, the chief of police or his or her designated representative shall have the power to direct the stopping, standing, or parking of vehicles, or the use of streets by vehicles, contrary to the provisions of this title, whenever he or she finds it necessary to assure the orderly flow of traffic or protect the public safety.

§ 7.52.040. Authority of police in crowds.

At places where large numbers of people and vehicles are to gather or have gathered, nothing in this title shall be construed to prevent any police officer from prohibiting any person from parking any vehicle upon or using any street or sidewalk, or from prohibiting any pedestrian from using any street or sidewalk. Such police officer shall have the authority to direct the parking of vehicles in any reasonable manner, way, or direction.
