§ 12.0501 Training of Law Enforcement Officers.¶
Pursuant to Penal Code § 13522, the County of San Bernardino, while receiving aid from the State of California, pursuant to said Chapter 1, will adhere to the standards of recruitment and training established by the California Commission of Peace Officers Standards and Training. § 12.0502 Sale and Disposition of Unclaimed Property.¶
(a) Inventory. Any and all unclaimed property now or hereafter coming into the possession of the Sheriff’s Office shall be inventoried at least every three months by the persons having custody of the same, and a full and complete list thereof shall be transmitted to the Sheriff. (b) Disposition of Unclaimed Property. The Sheriff, upon receipt of said list of unclaimed property, shall determine therefrom the unclaimed property that has been held by the Sheriff’s Office for a period of at least six months, or as may otherwise be required by Penal Code §§ 1407—1413, whereupon said Sheriff’s Office shall notify the Chief Probation Officer and the Director of Public Social Services of the availability of any bicycles or toys as the Sheriff may designate for being turned over to the Probation or Public Social Services Departments for use in any program or activities designed to prevent juvenile delinquency. The Sheriff may also retain and use any unclaimed property covered by this Section that he or she deems to be needed for use in undercover police operations or other functions of the Sheriff’s Office. The Sheriff shall keep an inventory of any property retained and used by the Sheriff’s Office and any such property which is suitable for sale will be sold as hereinafter provided when it is no longer needed for use by the Sheriff’s Office. Except as heretofore provided, the Sheriff shall cause the remainder of unclaimed property held for a period of at least six months, or as otherwise required by Penal Code §§ 1407—1413, to be sold at public auction as follows: (1) Notice of such sale, describing the property in sufficient detail for its identification, shall be prepared by the Sheriff’s Office, and said notice signed by the Sheriff, which said notice of said sale shall be given at least five days before the time fixed therefor by publication once in a newspaper of general circulation published in the County of San Bernardino. (2) Said property so offered for sale shall be sold to the highest bidder for cash, provided that the Sheriff may, in his or her discretion, fix a minimum sale price and may refuse to sell unless said minimum price is offered. (c) Disposition of Proceeds with County Treasurer. The proceeds of said auction sale or sales shall immediately be deposited with the Treasurer of the County of San Bernardino and placed in the General Fund thereof. (d) Safekeeping of Unclaimed Property. It shall be the duty and responsibility of the Sheriff’s Office to safely keep any and all unclaimed properties subject to the provisions of this Section and to the right of the Sheriff to sell said properties at public auction as herein provided, whereupon property which is sold shall be delivered to the purchaser upon payment of the purchase price. (d) Definition of Unclaimed Property. Whenever in this Chapter the following words and phrases set forth in this Section are used, they shall, for the purpose of this Chapter have the meanings respectively ascribed to them in this Section: UNCLAIMED PROPERTY shall include any and all lost, abandoned or unclaimed personal property of whatsoever kind or character, but shall not include property which is specifically ordered to be destroyed by provisions of law, nor to the disposal of dogs, cats, or livestock. § 12.0503 Establishment of Glen Helen Prisoner Rehabilitation Facilities.¶
Pursuant to the provisions of Government Code § 25351, the Glen Helen Prisoner Rehabilitation Facility, the improvements for which have been constructed at or near Verdemont, California, is hereby established. Said Glen Helen Prisoner Rehabilitation Facility shall be conducted as part of the jail system of the County of San Bernardino, State of California, by the Sheriff of said County in accordance with Government Code § 26005 and other applicable provisions of law. § 12.0504 Permit for Public Meetings.¶

§ 12.0506 Establishment of West End Sheriff’s Substation.¶
(a) Pursuant to the provisions of Government Code § 25351, the Sheriff’s West End Substation, the improvements for which have been constructed near the junction of Mountain Avenue and Highway 99, in the City of Ontario, California, shall hereby be established. (b) Part of County Jail System. The jail facilities at the Sheriff’s West End Substation shall be conducted as part of the jail system of the County of San Bernardino, State of California, by the Sheriff of said County in accordance with Government Code § 26605 and other applicable provisions of law. § 12.0507 Establishment of Central Jail Facilities.¶
Pursuant to the provisions of Government Code § 25351, the Central Jail Facility, the improvements for which have been constructed at 630 Cardiff, San Bernardino, California, is hereby established. Said Central Jail Facility shall be conducted as part of the jail system of the County of San Bernardino, State of California, by the Sheriff of said County in accordance with Government Code § 26605 and other applicable provisions of law. § 12.0508 Establishment of Branch County Jail Facilities.¶
(a) Pursuant to the provisions of Government Code § 25351, the following branch jails shall be established. (1) Victorville Substation Jail — 15579 Eighth Street, Victorville, California 92391. (2) Barstow Substation Jail — 225 East Mountain View, Barstow, California 92311. (3) Twentynine Palms Substation Jail — 6136 Adobe Road, Twentynine Palms, California 92277. (4) Big Bear Substation Jail — 40910 Big Bear Boulevard, Big Bear, California 92315. (5) Trona Substation Jail — P.O. Box 1053, Trona, California 93562. (6) Needles Substation Jail — 1111 Bailey Street, Needles, California 92363. (b) Part of County Jail System. The jail facilities, located as listed above, shall be conducted as part of the jail system of the County of San Bernardino, State of California, by the Sheriff of said County in accordance with Government Code § 26605 and other applicable provisions of law. § 12.0509 Prisoner and Probationer Labor on Public Works.¶
(a) Prisoner. For the purposes of this Section, PRISONER means any person confined in the County Jail, industrial farm, road camp or similar restrictive County facility under a final judgment of imprisonment rendered in a criminal action or proceeding or as a condition of probation after suspension of imposition of a sentence or suspension of execution of a sentence. (b) Probationer. For the purposes of this Section, PROBATIONER means any person under the charge of the court granting probation or the Probation Officer, who is required to work at public work pursuant to Penal Code § 1203.1. (c) Labor. For the purposes of this Section, LABOR means any physical or mental activity or work directed toward the production of services or goods. (d) Public Works or Ways. For the purposes of this Section, PUBLIC WORKS OR WAYS means any project or improvement constructed or maintained by the County of San Bernardino and districts governed by the Board of Supervisors and including, but not limited to, parks, buildings, paths, roads, streets, expressways, public road and flood-control rights of way or easements, reservoirs, canals, and sewers. (e) Prisoners and Probationers Compelled to Labor. Any or all prisoners and probationers may be compelled to labor upon the public works or ways of the County of San Bernardino or to perform such other work for the County or districts governed by the Board of Supervisors as may be assigned. The assigned work shall be compulsory as an incident of incarceration for prisoners or an incident of probation for probationers. No prisoner or probationer engaged in labor pursuant to this section shall be considered a County employee, nor shall any such prisoner or probationer come within any of the provisions of the California workers’ compensation system or the Workmen’s Compensation Insurance and Safety Act of 1917. (f) Direction of Labor. Work assignments of prisoners provided for in this Section shall be made by the Sheriff, and the work shall be performed under the direction of a responsible person designated by the Sheriff or by work crew supervisors pursuant to § 12.1101 of this Code. Work assignments of probationers provided for in this Section shall be made by the court granting probation or the Probation Officer, and shall be performed under the direction of a responsible person designated by the court granting probation or the Probation Officer. The Sheriff of San Bernardino County is authorized and directed to collect and receive from defendants costs authorized by Penal Code § 1209. The Sheriff shall deposit all funds received under this Section in the County Treasury. (Ord. 2769, passed - -1983)
§ 12.0511 Search and Rescue.¶
Pursuant to Government Code § 26614, the Sheriff shall have the authority to search for and rescue persons who are lost or are in danger of their lives within or in the immediate vicinity of the County. (Ord. 3209, passed - -1988)
§ 12.0512 Consolidation of Offices.¶
Effective February 25, 2010, the Offices of Sheriff/Coroner and Public Administrator are hereby consolidated. The person filling the consolidated office shall be the current Sheriff/Coroner and shall be known as the Sheriff/Coroner/Public Administrator and shall take the oath and give the bond required for each office, and shall discharge all duties pertaining to each office. The salary of the Sheriff/Coroner in effect on February 25, 2010, shall be increased in the amount of $10,000.00 in recognition of the additional duties resulting from the consolidation of offices. Any reference in this Code to Sheriff or Coroner or Public Administrator shall mean Sheriff/Coroner/Public Administrator. (Ord. 3936, passed --2004; Am. Ord. 4097, passed - -2010)
§ 12.0513 Reserve Deputies.¶
(a) Level One Deputies. Pursuant to Penal Code § 830.6(a)(2), qualified reserve deputies of the Sheriff who are assigned by the Sheriff to the prevention and detection of crime and the general enforcement of the laws of this State, and who meet the enhanced criteria established by the Office of the Sheriff and qualify as Level 1 Reserve Deputies pursuant to Penal Code § 832.6(a)(1), may be appointed by the Sheriff as a “Designated level 1 Reserve Deputy Sheriff” and deemed to be peace officers, possessing the powers described in Penal Code § 830.1. The Sheriff may revoke the authority of any such deputy at any time. (b) Other Level Deputies. All other reserve deputies of the Sheriff shall be permitted to perform the duties, functions, and tasks described in Penal Code §§ 830.6(a)(1), 832.6(a)(2) and 832.6(a)(3), in keeping with their level of certification issued by the California Commission on Peace Officers Standards and Training. The Sheriff may revoke the authority of any such deputy at any time. (Ord. 4120, passed - -2010)
