There is in the government of San Bernardino County a Department of Agriculture/Weights and Measures. (Ord. 1617, passed - -1971; Am. Ord. 2291, passed - -1978; Am. Ord. 2809, passed - -1983; Am. Ord. 3498, passed - -1992; Am. Ord. 3668, passed - -1996)

The executive officer of the Department of Agriculture/Weights and Measures shall be the Agricultural Commissioner/Sealer who shall have the powers and duties conferred upon these offices by the laws of this State. Subject to the provisions of this Chapter, the Agricultural Commissioner/Sealer shall have the power to appoint, discipline and assign duties to all assistants, deputies, and all other employees necessary to conduct the duties of the Department. The Agricultural Commissioner/Sealer and all deputies and staff shall each have a license of eligibility, appropriate to the position, from the Secretary of the State Department of Food and Agriculture or the Director of the State Department of Pesticide Regulation, which license shall be kept in full force and effect as provided by law. The provisions of State law relative to the term for Agricultural Commissioner and Sealer of Weights and Measures shall not be applicable; appointments to this position shall be in accordance with the Charter and applicable ordinances of the County and the position shall serve at the pleasure of the appointing authority. The duties of the Department of Agriculture/Weights and Measures shall be: (a) Enforcement of the provisions of the laws of this State pertaining to weights, measures, devices, containers, packages and advertising, including the provisions of Division V of the California Business and Professions Code; (b) Enforcement of the provisions of the laws of the State pertaining to the use, storage and handling of pesticides, production of agricultural commodities, shipments of plants and plant products; including the provisions of Food and Agricultural Code Division 4, Division 6, Division 7, Division 12, Division 13, Division 17, Division 18, and Division 23 and Business and Professions Code Division 3, Chapter 14.
