§ 12.4101 Establishment.¶
Pursuant to the provisions of the California Government Code, there is established a Planning Commission for the County of San Bernardino, State of California. (Ord. 3698, passed - -1997)
§ 12.4105 Appointment of Members.¶
(a) The Planning Commission shall consist of five members. The Board of Supervisors shall appoint one member for each supervisorial district, who has been recommended and nominated by the supervisor from that district. Each appointment shall be by majority vote of the Board of Supervisors. (b) In compliance with Public Utilities Code § 21670.1, when a decision involving land use and/or a development project located within the boundaries of an airport comprehensive land use plan, an airport land use compatibility plan or similarly entitled plan, and the Planning Commission is acting in the capacity of an Airport Land Use Commission, the Planning Commission shall be augmented with two members who have expertise in aviation as defined in the Public Utilities Code § 21670(e). The two additional members of the Planning Commission shall be chosen from the appointed membership of the County Airports Commission as described in Chapter 16 of this division and title. The members of the Airports Commission selected to augment the Planning Commission shall include one member that represents the Supervisorial District in which the development project is located, if feasible. The other member, or both members if it is not feasible to include one member that represents the Supervisorial District in which the development project is located, shall be chosen by the Airports Commission on a rotational basis and considering a member's availability. This augmentation shall be required even if the Planning Commission already has as part of its regular membership one member who has expertise in aviation. If the Planning Commission already has as part of its regular membership two members who have expertise in aviation, the Commission shall not be augmented with additional members. § 12.4110 Term of Office.¶
(a) Pursuant to San Bernardino County Code § 12.3701, the appointment of a commissioner shall expire on the date that the Supervisor who recommended the appointment leaves office, while the underlying term shall continue pursuant to Subdivision (b) below. (b) Each term of office for a planning commissioner position shall be four years, commencing on February 1 and ending on January 31 of the fourth succeeding year. The terms of office for commissioners for the Section and Fourth Supervisorial Districts shall expire on January 31, 1999, and on January 31 of each fourth succeeding year thereafter. The terms of office for commissioners for the First, Third and Fifth Supervisorial Districts shall expire on January 31, 2001, and on January 31 of each fourth succeeding year thereafter. (c) Notwithstanding Subdivisions (a) and (b) above, any member of the Planning Commission may be removed from the Commission at any time on the motion of the supervisor who nominated the commissioner, approved by majority vote of the Board of Supervisors. (d) The eligibility of any member of the Airports Commission to augment the Planning Commission for review of any development project located within the boundaries of an airport comprehensive land use plan, an airport land use compatibility plan or similarly entitled plan shall cease at the expiration of the term of appointment of that Airport Commissioner in accordance with § 12.1603 of this division and title. § 12.4115 Stipend and Expenses.¶
Planning Commissioners shall receive a stipend and expenses for their attendance at each meeting in a sum to be fixed by the Board of Supervisors. (Ord. 3698, passed - -1997)
§ 12.4120 Functions.¶
The functions of the Planning Commission shall be as set forth in the California Government Code, San Bernardino County Code and County policy. (Ord. 3698, passed - -1997)
§ 12.4125 Procedures.¶
Rules adopted by the Planning Commission for the time, place and conduct of its meetings shall take effect upon ratification by the Board of Supervisors. (Ord. 3698, passed - -1997)
